On its own, Congress has clear authority to arrest and jail Lois Lerner until she testifies. That is the best way to end the stonewalling about the IRS targeting of the Tea Party and other conservatives.
There is no better option.
Nobody expects Attorney General Eric Holder to prosecute Ms. Lerner. His hyper-political Justice Departments investigation of the IRS scandal is an obvious sham.
Expecting either the attorney general or a court to be the enforcer against Ms. Lerner would show the House commitment to accountability is soft. The House can and should use its own power to arrest and confine her, just as courts commonly do with other witnesses to compel testimony.
The mainstream media ignore the ongoing IRS scandal rather than digging for new disclosures. The president proclaims there is not a smidgen of corruption involving the IRS. It would be fascinating to learn how testimony from Lerner could change Obamas bragging.

Great idea. But why stop with Lois? Arrest Obama and Holder while you’re at it.
So just how is Congress going to get Ms. Lerner to testify, beat it out of her? She won’t talk period. I know from firsthand experience that IRS employees, especially managers, think they can do ANYTHING, because NO LAWS apply to them. They ARE the law (in their minds)
Put her in jail.
Or at least the latter.
And the IRS has a SWAT team to protect Ms. Lerner.
Let her rot in jail. Make a plea deal if she spills the beans and implicates the white house. Then impeach the bastard.
You got it!
Boehner is a Democrat, a corrupt Democrat. But I repeat myself.
Show her Karl Rove videos until she cracks.
It would need the consent of Boehner to do this. Either the House or Senate has the power to arrest for contempt and other matters. See the trial of Sam Houston in the House for a physical attack on a sitting Congressman. There is a jail in the Capitol, but no person may be held absent a vote of the entire body and then only as long as the Congressional Session. She would be released on 12/31.
Trash, and not even first class trash at that.
That’s exactly what the House should do but Boehner hasn’t got the guts to do it.
Zero will never let it get to that point. I fully expect him to issue executive pardons for both of these a$$clowns.
The incoming House is all but certain to remain in Republican hands, adding at least two additional years to Lerner's confinement. Actually, I don't see her holding out that long. I think she'd start singing within days of being locked up.
This is absolutely correct but we have quivering ganglia republicrats wavering!! That is why MILLIONS of former “republicans” are now “INDEPENDENT” . Republicrats like bush boner christie rubio — SUCK!!
Can’t pardon unless there is a conviction
They can. But they wont. The democrats and the liberal media will go into propaganda overdrive, circling the wagons around her “big bad republicans jailing poor innocent women!”) and making the republicans waste their political capitol on this instead of on the upcoming 2014 elections.
Brother Jaz, I think you’re right, unfortunately.
This whole “war on women” nonsense is the weapon Obama is using to spook Boehner and keep him from using the inherent power of Congress.
But won’t it be grand if we are both pleasantly surprised! ;-)
You bet it’ll be grand and I truly hope we’re both wrong about him.
You’re probably right about the “war on women” thing between the two and that’s a complete farce too but the Rats are playing it for everything they’ve got.
If the president issued a pardon for any crimes Lerner committed while at IRS, then her claim that testifying might incriminate her would be a moot point. She only has a 5th amendment right to not testify while she has criminal liability.
And if the House does manage to get her locked up, I expect that several female Dem reps will get locked up with her..in solidarity...
Debbie Wasserman-Schultz, Sheila Jackson Lee, and Eleanor Norton Holmes!!!
LOL! In less than 24 hours Lerner would begging to testify!
A pardon only works on convicted felons, not those under arrest.
Yes, they can. No, they will not. Boehner doesn’t want her arrested, he agrees with what she’s been doing.
Ford issued a full and unconditional pardon of Nixon:
“for any crimes he had committed, or may have committed, or taken part in as president”.

A short stay in the Capital Jail could be made to feel like a lifetime for an Elite Washington Liberal on a M.R.E. Meal plan...
Add some speakers with Rush in the Afternoons & Fox in the evenings...& She's "One flew over the Cuckoo's Nest" in a heartbeat!
Alas, that would be Cruel & Unusual Punishment for our Elites...
It would take the great liar mac daddy 1 second to issue an executive order to have her released with no possibility of her ever being arrested again.
Lerner should be hung,
Course congress hasn’t the guts to do squat here.
--SNIP--The House Ways and Means Committee Republicans have not ruled out its inherent contempt authority to arrest former IRS chief Lois Lerner if Eric Holder continues to refuse to act on the panels vote to seek an investigation of Lerner and her role in the IRS targeting scandal.
The Washington Examiner reports, House Speaker John Boehner (R-OH) spoke about the committees threat to hold Lerner in contempt: "The Ways and Means Committee, led by Chairman [Dave] Camp [R-Mich.], has conducted a serious and thorough investigation of the IRS, uncovering abuses and criminal acts that should be prosecuted to the fullest extent of the law."
"As I've said, if Lois Lerner continues to refuse to testify, then the House will hold her in contempt. And we will continue to shine the light on the administration's abusive actions and use every tool at our disposal to expose the truth and ensure the American people get the answers they deserve."
The constitutional inherent contempt authority gives the House power to hold Lerner until a new Congress is convened in January 2015, which could then renew the subpoena if she continues to refuse to testify, though Republicans are not emphasizing that option.
Rep. Kevin Brady (R-TX) told The Washington Examiner, "I think we'll deal with that, should that occur, but I think this too is an ongoing investigation, and, frankly, for the attorney general to turn a blind eye to this evidence would discredit him greatly.
