State Dept.: Kerry Will Not Comply with Benghazi Subpoena

Secretary of State John Kerry has been subpoenaed to testify on Benghazi on May 21st. However, in the daily State Department press briefing on Monday, deputy spokesperson Marie Harf said that Kerry will be out of the country on that day and won’t comply with the subpoena to testify on that particular date. Harf said that Kerry “has been made aware” of the subpoena, but still plans to be out of the country and in Mexico on the 21st. She said the State Department was “surprised” that Darrell Issa skipped over offering an invitation and went straight to issuing a

He has every responsibility to comply with ANY lawful Subpoena. He should be compelled to attend, by force of arms if necessary. If for no other reason than to show that regardless of political position and personal wealth, no one is above the law.

Simple solution:

In the FY 2015 budget, allocate ZERO dollars to any Federal department or agency which has not responded to subpoenas.

After all, all budgets MUST originate in the House. . . and if Justice, State, HHS, etc decide not to comply with the lawful requests of the House. . . .shut them down. Completely.

Supposedly this was a pre-scheduled trip and Issa didn’t check before issuing the summons. I would imagine the SOS would publish a calendar, but maybe not, in this admin.

In any case, it should be easy enough to determine whether Kerry’s trip was already scheduled or not.

It was stupid of Issa to issue a subpoena and not first make an attempt to schedule an appointment with his office.

For all we know he was invited by back-channels and refused.

Quite frankly, now that Boehner is finally appointing a special committee it makes no sense for Issa to be throwing around subpoena’s on Benghazi. The Republicans do look foolish having 5 committees investigating the same topic. Roll the separate investigations into one, hire a good PR person to work with Gowdy, and get moving.

Agreed on all points. In the meantime, let Issa issue a contempt citation (which we know will go nowhere) and wait until Gowdy's special committee subpoenas Kerry too. When/if he refuses to comply with that one, arrest him.

This article is two months past the original ruling, so the Bush Admin was supposed to comply with this ruling, and I can’t find anything to say they did not or did....you may ask your congressman, since the question applies to Obama WH now.

The Bush ruling would have been a precedent case for the current ruling, so Obama WH should be told to comply.
