This came as a result of California State Senator Abel Maldonado (RINO). For Abel's vote on Governor Arnold Schwarzenegger's 2009-2010 budget (the only Republican vote for it), Abel got two ballot initiatives put on the ballot by the Democrat majority, one of the initiatives being the "top two" primary, where the top two vote-getters, regardless of party, would face off in the general election.

This was his attempt to make it easier for Abel to make it to a general election if he didn't have to face a Republican-only vote. He ended losing anyway in the next general election to Gavin Newsom for Lt. Governor. Now mind you that Abel was appointed as a Lt. Governor prior by Arnold Schwarzenegger as reward for Abel's vote on the budget, so Abel was the incumbent (albeit an appointed incumbent).

For what it's worth, the CAGOP had opposed Prop 14 (the top two primary initiative).
