Feds to schools: You must accept children of undocumented immigrants

The Justice and Education Departments are teaming up to remind public schools that they are required to provide all children with equal access to education at the elementary and secondary level regardless of their parents' or guardians' citizenship or immigration status.

The "dear colleague," letter to schools providing guidance to schools on their legal obligations comes as the departments say they have "become aware of student enrollment practices that may chill or discourage the participation, or lead to the exclusion, of students."

I don’t hear many public schools resisting it.

There’s extra money in it because schools ask for more money for bilingual teachers.

The schools don't have a choice. SCOTUS ruled in 1982, Plyler v. Doe, that schools must accept illegal aliens.

In California the schools get fed funds by the head, i.e., the more illegal kids, the more of your tax money goes to support education in Spanish [ it`s true- I was asked to teach computer classes in a California public grade school
and most 75% of the kids were illegals -I could only teach the whole class in spanish- per contract -thus I refused]

So not only am I paying for their healthcare, my local taxes must fund their education? Wealth redistribution? Where in the constitution does it state I need to support non-citizens/lawbreakers?

They also will force schools to no only hire more esl teachers, but the teachers must also be the right race. Can’t have kids taught by qualified teachers of the wrong race.

Here in Fairfax County, VA, it costs $104 million a year just for the 1000 ESOL teachers for the 31,000 ESOL students. When you take a look at the full costs for each of these students, the costs run to over $400 a million a year out of a school budget of $2.4 billion. Property taxes have been raised again to cover the additional costs.

What people may not realize is that although the federal government establishes immigration policies, the real costs are being absorbed locally. Why are we bringing in 1.1 million LEGAL IMMIGRANTS A YEAR? It really doesn't matter if the children are legal or illegal, the costs are the same.

• There are 10.4 million students from immigrant households in public schools, accounting for one in five public school students. Of these students, 78 percent speak a language other than English at home.

• Overall, one in four public school students now speaks a language other than English at home.

Children who cannot provide proper papers have been in California schools since the mid-60’s

The teachers unions wanted more teachers hired, so they demanded that no interference with a ‘child’s education’ be made against the illegals.

Ask any parent who has had a kid in Los Angeles County schools in any time period since the 60’s.

Got it. So the justice department can avoid following the law and removing illegal aliens because they have the right to assign resources, but a local school district must follow the law to the letter, resources be damned.

Let me guess, flexibility is allowed on immunization records.

If I lived in the area and had a kid attending school with an unimmunized kid, I’d sue till they ended the public health hazard.

10 million PLUS just in the schools?

Tell me again how many illegals there are in the country TOTAL—it sure as heck isn’t 11 million.

What if it is much closer to 55 million?

What then?

How does AMNESTY hurt us??? In more ways than I can count.

I believe that the schools are even prohibited from asking for an immunization record from the children’s parents.

I don’t think so. Even in Tucson, they require immunization records and a birth certificate and a valid address within the school district. They just can’t ask for citizenship papers or a green card.

Your problem isn’t fedgov. The problem is your state and school district taking Uncle Fedgov’s money and all the strings that come with it. It’s very convenient to blame the feds, especially if you’re part of the state and local cartel machinery, but your problem here is much closer to home.

But the best part for Democrats is, the citizen-kids will do almost as poorly as the squatters’ kids because gangs enter the school environment and caring White parents take their kids out of these dangerous situations. With the left-over Whites doing as poorly as the transplants, they can achieve the Nirvana of Leftists: Equality and Fairness.

In the late 80s and early 90s, over 90% of the births in Los Angeles County run hospitals were the children of illegal immigrants. Of all the services provided, it was between 70 to 80% illegal immigrants. My mother used to take calls from Mexico asking what services a person would get if they crossed over and presented at the hospital.

I have heralded this long before I came to Free Republic. No one gave a damn. Aw, it was California...

Well folks, now it’s happening across the nation. Not so funny anymore is it.

What happened in California, is now happening to the nation.

Around the year 2000, I traveled to Washington, D. C. While there I saw an issue of the Washington Post. In big headlines it heralded the fact that during the previous decade, the Hispanic populace had grown in the Washington area by 300%. Another words, for every 1000 there had been in 1990, there were now 4000 in their place.

That was in the vicinity of our nation’s capital in the year 2000.

We allowed our nation to be stolen. It was all a big joke, had to be someone who was racist who addressed this issue.

Welcome to Mexico II folks.

From immigrant households, legal and illegal. According to the government, there are 45 million foreign born in this country with 11.5 being illegal aliens. The children could be US citizens if born here. There are 300,000 to 400,000 anchor babies born each year in the US. They automatically become citizens thru birthright citizenship.

It should be challenged again. If you read the SCOTUS decision, the justices decided that the costs were insignificant for the school district to accept the additional students. That is no longer the case.

When the great stimulus scam was announced my county asked for a bunch of money for multi lingual teachers because the number of non english speaking students had increased by 50% from the previous census. This is in a state with a relatively low number of illegals.

Correct. Coupled with LBJ’s Great Society and JFK’s unionization of public workers, the die was cast for the society to be undermined, forever.

Cloward and Piven were just accelerators on a fire that was started back with Wilson and FDR.

We fought Communism in Korea and Vietnam, all while the other Marxists infested Capitol Hill, Academia and Hollywood/Media.

You don't seem to get it. It has nothing to do with federal money. It has to do with the law of the land. Public schools, even without federal money, cannot discriminate against illegal alien children any more than they can on the basis of race. The Feds have jurisdiction, period.

All public school students should have to prove legal residence in the school district. As for illegals, with the Obama economy, I expect them to continue deporting themselves. Good riddance. I’m in favor of legal immigration, subject to thoughtful legislation regulating both their numbers and their qualifications, but I have no more tolerance or forgiveness for criminals who break the law to enter our country than for those who break the law to enter my home.

If you look at the numbers post 1965 until 1986, it reveals an immigration that isn’t totally broken as it relates to Mexican, Central, and South American illegals.

In 1986, the bill Reagan signed, provided Amnesty for 3.5 million illegals. Those illegals had traveled here over the prior 30 years. That puts the yearly figure quite low.

The bill Reagan signed provided for tough employer sanctions, and strengthening our border INS services.

The problem is, after that bill was signed, the only thing that was enforced was the amnesty.

Subsequent to the bill, the border wasn’t shored up. Inland enforcement was abandoned. Cities declared themselves Sanctuary cities, and law enforcement suddenly refused to turn in illegals as they had in the past.

When that bill was passed, I thought it was sending the wrong message. We have seen what resulted. It was an open border free-for-all, and that isn’t what Reagan signed into law.

Bush, Clinton, Bush, and now Obama allowed our nation to be occupied by foreign nationals. Mexico has essentially occupied our territory with it’s citizens. California is essentially a Mexican state. The Mexican government and it’s consulates run the show. ID’s are provided there. Now our banks accept them. These people all get US services for free.

It’s a joke. The 1965 act and the 1986 bill did not authorize what is taking place now. Asshole presidents on down have created this mess, and laying it at Reagan’s feet as some people do, reveals a complete lack of understanding of actually took place.

Bush was perhaps the single most idiotic individual in the whole mess, because his dim-witted proposal to grant another Amnesty was alone probably responsible for ten to fifteen million new illegals in country.

After the 1986 bill, we should be smarter than to ever buy off on this again.

We need to stop cold any services to illegal immigrants whatsoever. We should start going after businesses, apartment owners, and anyone else who helps them here.

Local cities and police agencies that do not comply with federal law concerning immigrants should lose their ability to obtain any funds from the federal government.

If this were done, we would see repatriation to their nations of origin. That’s the only reasoned thing to do at this point.
