Leno said state law requires that fines could only be issues for unlawful, unfair, fraudulent conduct, but agreed to consider adding specific language to the bill that fines could only be imposed if there is malicious intent.
Jamie Hastings, vice president for external and state affairs at CTIA-The Wireless Association, said in a statement that the industry has already taken significant steps to protect consumers, including voluntarily including software on phones starting next year that allows users to remotely erase their data and prevent phones from being reactivated. The industry objects to having confusing state-by-state laws.
Leno said the voluntary action isnt enough because owners would have to find and activate the software. His bill requires that a kill switch be included as the default setting.

Will the kill switch work on my dumb phone?
I read in Nevada they were shutting down cell towers around the Bundy ranch.
It's for the market to decide whether a kill-switch is a feature or a bug and whether, if it's a feature, it's worth whatever it costs. If the answer is yes, then phones will have the kill switch, just as they have pinch-zoom.
Leno needs to be out of government and doing something socially useful, such as flipping burgers, until that job can be automated out of existence.

The “kill switch” will be used to ensure that no embarrassing pics or video of police or other government representatives exist. That will be the primary purpose.
