Supreme Court Green-lights Indefinite Detention Of Innocent Americans

America’s founders, largely distrustful of centralized power, created several checks and balances into the U.S. Constitution to help ensure that one person, or one group of people, would not be able to unilaterally exert his or their will over the American citizenry. First, the federal government itself was divided into three separate and distinct branches–each holding the capability (and responsibility) to check the power of the other. Second, the Bill of Rights was made part of the Constitution for the protection of individual liberties. Third, the “free and independent states” of the nation retained their sovereignty and independence after the central government was created (by the states), with the Tenth Amendment specifically recognizing their authority and jurisdiction over matters not directly delegated to the federal government.

It was also assumed that the freedom of the press and the freedom of religion would help the citizenry be sufficiently informed and inspired to keep the would-be despots at bay. And, of course, “We the People” are recognized as being the ultimate guardians of liberty by the recognition that “to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed.” (Declaration) The “consent of the governed” was given teeth by the constitutional recognition of the people’s right to wield the power of the voting booth, the jury box, and, as a last resort, the cartridge box.

What has become increasingly obvious to a large segment of the American populace is the complete unwillingness of the national media to hold the federal government accountable. Neither do America’s pulpits provide the moral leadership necessary to maintain good government. The freedom of the press and religion accomplish precious little today in the safeguarding of liberty. And it is also absolutely clear that the three branches of government...

“Eighty-five of 100 senators voted in favor of the new version of the NDAA, which had already been quietly passed by the House of Representatives. [Disgustingly, Montana's only U.S. House member, Republican Steve Daines, who purports himself to be a staunch conservative, voted for the indefinite detention provision of the NDAA, as did Montana's two Democrat Senators Max Baucus and Jon Tester. How did your congressman and senators vote? In my opinion, this is a monumentally-important vote; and a vote granting this unconstitutional power to the military and federal police agencies is inexcusable and demonstrates how both Democrats and Republicans will unite together to dismantle the constitutional protections of the American people in the name of "national security."]

Supreme Court rejects hearing on military detention case

(Reuters) - The U.S. Supreme Court on Monday handed a victory to President Barack Obama’s administration by declining to hear a challenge to a law that allows the U.S. military to indefinitely detain people believed to have helped al Qaeda or the Taliban.

The high court left intact a July 2013 2nd U.S. Circuit Court of Appeals decision that journalists and others who said they could be detained under the law, did not have standing to sue.

The provision in question is part of the National Defense Authorization Act, which the U.S. Congress passes annually to authorize programs of the Defense Department.

It lets the government indefinitely detain people it deems to have “substantially supported” al Qaeda, the Taliban or “associated forces.”

Well, now that posse comitatas (sp?) is obsolete, little barry can just send the troops into any area/region not obeying his edicts and have the offending threats detained until passified don’tchaknow.

Since we can't look to the Courts for protection anymore, may I suggest that everyone become proficient at protecting themselves.

Not a ruling, just their standard fare of letting a lower-court's ruling stand. (Much like CA's Prop 8.)
(They would also likely deny standing to anyone challenging it.)

The problem is that implicit in the action is the guilt:
That is to say that the detention under the accusation [of Al Queda or Taliban association or support] prevents challenging the accusation.

In essence, this is an end-run around the 6th amendment:

Amendment VI
In all criminal prosecutions, the accused shall enjoy the right […] to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; […]
There is no way to challenge the veracity of the charge and because its detention rather than prosecution they hold that it's all perfectly legit.

Claims weapons were pointed at federal officers triggers criminal investigation

The FBI has launched a formal criminal investigation into the events surrounding last months standoff between the Bureau of Land Management and Nevada rancher Cliven Bundy.

Agents have been interviewing BLM agents and law-enforcement officers who had been onsite, focusing on charges Bundy supporters and militia members who joined them pointed weapons at the authorities and made threats on their lives, reports KLAS-TV, Las Vegas.

FBI agents have interviewed Clark County Sheriff Doug Gillispie, Assistant Sheriff Joe Lombardo and a squad of Metro police officers who served as a buffer between Bundy’s supporters and the BLM forces. A second squad is to be interviewed this week.

“The federal authorities are conducting an investigation and I am pretty confident it is going to go into the future,” said Lombardo, who was interviewed by the FBI earlier this week.

Asked if there would be consequences for somebody recorded on video tape or a news camera pointing a gun at a Metro officer or a federal ranger, Lombardo said yes.

“There is definitely going to be consequences, definitely. That is unacceptable behavior. If we let it go, it would continue into the future,” he said.

Sheriff Gillispie confirmed he was asked what he observed, but declined to give details.

KLAS reported earlier that Metro members claimed they had feared for their lives because of so many armed supporters standing with the Bundys, who had “pointed weapons at officers, taunted them, told them they should be ready to die.”

The NAZIs were working legally and totally within the law at the time and their actions upheld by the courts.

Unless based on God’s law, the rule of law and the courts are pretty much meaningless.
