Boehner: House won't arrest Lerner

By Russell Berman - 05/11/14 10:53 AM EDT

The House has held Lois Lerner in contempt, but it won’t use its power to place the former IRS official under arrest, Speaker John Boehner (R-Ohio) said on Sunday.

Under a precedent affirmed by the Supreme Court, each chamber of Congress can authorize its sergeant-at-arms to detain individuals it holds in contempt. But Boehner said on "Fox News Sunday" that he has no interest in doing that with Lerner, whom the House last week voted to hold in contempt over her refusal to testify about her role in the IRS’s targeting of conservative groups.

“I’m not sure we want to go down that path,” Boehner said. “It’s never been used,” he said of the provision allowing Congress to arrest individuals and place them in the Capitol jail. The Senate has in fact used that power, but not in the last 80 years. “I’m not sure that it’s an appropriate way to go about this,” Boehner said.

The contempt charge has been referred to the Justice Department, and Boehner said it is up to Attorney General Eric Holder to prosecute Lerner.

“Now will he do it? We don’t know, but the ball is in his court,” Boehner said.

The U.S. attorney’s office in Washington has said it is reviewing the referral. Lerner has repeatedly invoked her Fifth Amendment right against self-incrimination, but the House contends she waived that right by defending herself in an opening statement at a House hearing last year before she refused to answer questions from lawmakers.

“up to Attorney General Eric Holder to prosecute Lerner.”

No, not him, the US Attorney in DC SHALL bring the matter before the appropriate court for consideration.

The Republicans simply do not have the power to render justice to Obama’s commissars. The commissars know they will be protected by Obama and Holder. Boehner needs to be more creative.

The House Boner fails to rise to the challenge ... again. Why even bother with a contempt vote if you're not going to enforce it?

Just another example of why no matter how many conservatives are elected over RINOs/GOPEs, if the leadership doesn't change not much else will.

And we need to remind both parties that we will continue to demand justice after the elections so they may as well get with it.

Too often things like this have been allowed to slide down the memory hole because we won and the urgency went away.

“Now will he do it? We don’t know, but the ball is in his court,” Boehner said.

So, Speaker Boner, if I guess that Holder won't do a thing about it (and I KNOW that I will be correct), does that mean you will resign? After all, if I, a nobody, bests you on political insight, maybe you ought to get lost.

Okay. So now we know that the FBI is afraid of Obama’s IRS and will not arrest anyone for breaking the law with their attacks against the American people. Now we see the GOP is also afraid of Barry’s IRS and is not going to arrest anyone for breaking the law. Don’t tell me that ObamaCare is “the law of the land”. Same goes for “gun control.” I don’t want to hear it. We don’t do laws in America anymore.

Exactly!!!

However twisted, immoral and socialist the Democrat party is, at least their base is confident that they have elected people who are not afraid to DO SOMETHING.

The conservatives in this country are stuck with the party of strongly worded letters, surrender, capitulation and raw steaks held to the eye.

The kids that get’s his lunch money stolen from the school bully every day knows that he is morally straight, but that is little consultation when he goes hungry every day. Until he stands up and fights back, he is just a victim and a sucker.

Not that anything else is expected of either Congress, Boehner, or Holder. No, Holder won’t prosecute Lerner anymore than Congress will detain her—only difference is Boehner is un-motivated because of fear, Holder is motivated because he perceives he is in control.

“Now will he do it? We don’t know, but the ball is in his court,” Boehner said.

The fact that he "don't know" that the arch-criminal running DOJ will piss on the contempt charge is the reason he won't be SOTH for much longer.

Americans are fed up with the lawlessness in DC and failure to hold the political class accountable for criminal activity.

How nice for Lerner.

She had no problem threatening ordinary Americans with arrest, huge fines, jail and even violence if they did not cooperate.

She tried to bankrupt them with legal demands, entrap them with arcane rules, and investigate the smallest aspect of their lives.

But Boner is worried about looking mean and maybe upsetting women.

Ask the Engelbrechts how they feel about that.

“I’m not sure we want to go down that path,” Boehner said. “It’s never been used,”

So says John "Poker Face" Boehner - but wrongly.

Even the NY Times knows more about congress than the Republican congressional leader:

Congress Has a Way of Making Witnesses Speak: Its Own Jail

"Congress Has a Way of Making Witnesses Speak: Its Own Jail In 1795, shortly after the Constitution was ratified, the House ordered its sergeant at arms to arrest and detain two men accused of trying to bribe members of Congress. The House held a trial and convicted one of them.

In 1821, the Supreme Court upheld Congress’s right to hold people in contempt and imprison them. Without this power, the court ruled, Congress would “be exposed to every indignity and interruption, that rudeness, caprice, or even conspiracy, may mediate against it.” Later, in a 1927 case arising from the Teapot Dome scandal, the court upheld the Senate’s arrest of the brother of a former attorney general — carried out in Ohio by the deputy sergeant at arms — for ignoring a subpoena to testify."

No we don’t. We have the “red short blue shirt” uniparty. The only difference is that, quite a number of the “blue shirts” are true believers in their marxist totalitarian vision, and will work day and night to enforce it. The “red shirt” side just wants to protect its perks and local power, and will cave on every plank in the platform to do so. They don’t care if they don’t attain the majority for purposes of directing the course of the country, they just want to protect their personal power and position.
