Ohio man who was shot in eye with Taser at traffic stop is suing police

Last May, Kelly was asleep in the passenger seat when his friend was pulled over for drunken driving on Interstate 71 between Cincinnati and Columbus, according to The Columbus Dispatch.

When Ohio State Trooper Bryan Cook woke Kelly, he was startled and began flailing his arms, according to the lawsuit.

Fayette County Deputy Clinton Sines then drew his Taser, opened the passenger door and shouted for Cook to get out of the truck and show his hands as he grabbed the back of Kelly's sweatshirt and tried to pull him out, the lawsuit says.

The lawsuit says Sines was apparently unaware that a still-confused Kelly was restrained by his seat belt.

"I'll taze you," Sines told Kelly as he continued to yank Kelly from the truck, according to the lawsuit.

When Sines' grip slipped, Kelly rose. That's when Sines fired his Taser, striking Kelly in the right eye, where a Taser prong became lodged.

Kelly fell back into the seat and covered his head with both arms, and Sines fired a second jolt into his eye, the lawsuit says.

Sounds like the injured passenger did nothing to deserve the treatment he received. Hope he wins the lawsuit.

As near as I can tell, the Fayette county tax payers can pay for Deputy Sines' vacation and Mr. Kelly's damages.

Complaint says man shot in eye with Taser

Matthew David Kelly, 24, of Harrison, sued on April 2 in U.S. District Court in Cincinnati, alleging near total loss of vision in his right eye after he was shot twice by Deputy Clinton Sines. He asked for compensatory damages of $5 million on each of four counts.

“Sheriff’s office. Show us your hands. I know you’re asleep, now get out,” as he grabbed the back of Kelly’s sweatshirt and began to try to pull him out of the truck.

Sines gave a couple of hard tugs, apparently unaware that the wordless and apparently confused Kelly was being held by his seat belt.

“I’ll taze you,” Sines told Kelly as he continued to yank Kelly from the truck. When Sines’ grip slipped, Kelly rose and Sines fired his Taser. The Taser prong struck Kelly in the right eye.

This, my friends, is what torture really looks like. This was a clumsy and brutal action. I’m surprised it’s taken this long to come to trial. Have these two cops been working since then? Hopefully, they were at least suspended for a while.

When the officer grabbed the half-asleep passenger by the jacket and yanked him halfway out of the car, did he think...why is he not falling out of the car onto the ground? (because his seat belt was on)

The Solution: Let go, and then about two seconds later Taser the man in the eye.

The dazed man, stunned and in pain, doesn't move very much. But a few seconds later he puts his hands over his head.

The officer screams, "Get on the ground. Get on the ground. Now! I'll do it again. Get on the ground." Then he sent "a second surge of high voltage electricity into Mr. Kelly's eye."

Drunks can be stupid, dangerous, and difficult to manage.

At least it wasn’t led that passed through the “sleepy” passenger’s eye socket.

And the more they pay, the more circumspect cops will have to be about abusing people.

Yes. . .past articles on fatal incidents have led some to comment, “Where was the taser. Why didn’t they just use the taser”?

Clicking Keyword taser above will bring up several articles where the taser itself was fatal.

But I’m glad for him that it was just the taser in the eye and not the gun. The Deputy Sheriff Clinton Sines was apparently not a model officer. . .

“...Sines’ disciplinary record, which includes a 1999 letter for unprofessional conduct, two reprimands in 2010 for neglect of duty and a 2011 action in which Sines was sued for violating the constitutional rights of an 18-year-old woman during a traffic stop.”
