In June of 2012 the Aurora PD blocked a street. Then they removed the occupants of over twenty cars, cuffed them and detained them. They caught the bank robber. This was only reported on one TV station, and Free Republic.

This should have been a major news event, but there has been no coverage. The short news clip at the link is all I can find. The title is the only text at the source.

If suits don’t sting them, the fact that the court forced the bank robber to be let go because the evidence was found in an illegal search might. The bank could still sue the robber, I suppose.

What is also very disturbing and scary is that I just don’t see this police state brutality and mentality as being solved via the court system. More often than not the courts are deciding end justifies means. IOW, the courts are ruling that we have no rule of law.

When the courts say that the law is whatever the police say it is at any given time, what recourse have the people?

The police definitely fouled up on this one, in that their GPS was only good for a general area, and they could not narrow it down to a single vehicle.

Importantly, just a few days ago, there was an armed robbery of a drug store in NYC, for Oxycontin, and along with the drugs the robber was given a pill bottle with a GPS transmitter in it. *Just* the robber was caught, some 30 blocks away, then he threw down on the police so they killed him.

And in the article they mentioned that this technique has been successfully used some 100 times across the US. Which means that GPS *was* able to narrow down to just one vehicle or residence.

“The law is clear that investigative detentions are lawful for a reasonable period of time,” Oates said. “Reasonableness is determined by the facts and circumstances at issue, and the facts and circumstances were the suspect was in one of 19 cars.”
These are known as Terry stops, named after a Supreme Court case. However, the period of time has to be brief, not reasonable. Reasonable applies to whether the detention can be made in the first place.

If the dough was tagged with a transponder, they would have found it... and presumably eventually returned to the bank. Something might have gone wrong with the close quarters tracking. A modern car or truck is largely a Faraday cage, especially in the trunk.

This was apparently done in such a broad sweep, though, that the robber skated.

Watching the video, it also looks like the LEOs were pointing their pistols right in the faces of the innocent motorists, including the kids.

Totally agree! They specifically allowed citizens the very top of the line military weapon of the day.

After all, the second amendment is explicitly intended to allow the citizens to protect themselves from an over-reaching government.

And to therefore discourage any future government from becoming too intrusive.
