Death Sought for Alleged Sierra LaMar Killer

Santa Clara County prosecutors said Monday that they will seek the death penalty against the man charged with killing Morgan Hill teenager Sierra LaMar.

Antolin Garcia-Torres, 22, pleaded not guilty in February to a grand jury indictment alleging that he killed Sierra, 15, in 2012 and tried to kidnap three women in 2009. Sierra's body hasn't been found.

"Given the facts of this case and after a comprehensive review by a committee of senior prosecutors, I have concluded that this defendant should face the ultimate penalty," District Attorney Jeff Rosen said in a written statement.

The indictment handed down by the Santa Clara County grand jury behind closed doors eliminates the need for a preliminary hearing of the evidence in open court, and means Garcia-Torres will proceed to a jury trial.

If convicted and sentenced to death, Garcia-Torres would join some 750 inmates on California's Death Row - the nation's largest.

“Investigators believe” is not enough for a death penalty conviction and never should be.

I don’t know why they even have the death penalty in CA, they just end up spending more money incarcerating them in a special block until they die of natural causes.
