Obama Administration Seeks Race Based Govt. in Hawaii

President Barack Obama’s administration has quietly suggested it is willing to create a two-tier race-based legal system in Hawaii, where one set of taxes, spending and law enforcement will govern one race, and the second set of laws will govern every other race.

The diversity proposal is portrayed as an effort to create a separate in-state government for people who are “native Hawaiians.”

If Obama succeeds, “what’s to prevent creating similar [self-governing racial] groups out of say, Cajuns, or Orthodox Jews or Amish?” said Gail Heriot, a commissioner on the U.S. Commission on Civil Rights.

“If you can do that with groups that are already part of the mainstream, you can balkanize the country,” said Heriot, who is a law professor at the University of San Diego.

The REAL story behind this is that the original legal challenge to the OHA (the Hawaii Trust that administers 1.8 million acres of HI for the "benefit of all inhabitants") came from a family rancher whose family has ranched there since 19th Century (that is, during the monarchy before HI became a territory). It went to the US Supreme Court and he won. Case was Rice vs. Cayetano. The organization- the Office of Hawaiian Affairs, run by a trust described in the Hawaiian Constitution.

This "regulation provision" from the Dept. of the Interior uses federal statutes that provide for the Bureau of Land Management,part of the Dept. of the Interior. This is a federal land grab, using federal funds to influence a state organization, a trust, which is run by elected trustees in state elections. A federal blatant land grab to make a political move within Hawaiian state politics. Blatant and unconstitutional to any who understand States Rights.

Perhaps we should look into the VA in Hawaii to see how our veterans are treated there. And re-visit the birth certificate of the main "non-Hawaiian" in chief, and his thug atty general. This is corrupt as all hell. More leftist federal control over state lands, agriculture and freedom-- through regulations. Buying "local" politicians for machine control, the chi-town way. Balkanizing our Republic.

The way these people think and act, this provides a template for Aztlan/LaRaza, and enforced by the Bureau of Land Management swat teams. Every where you look federal omnipresence, and destruction of our Constitutional Republic. The Soviet model of federal land theft.

Our Constitutional Scholar President must have forgotten that the “Separate But Equal” doctrine was overturned by the Brown v. Board of Education decision in 1954.

In the new Balkan US that ruling is being bypassed, for the “special downtrodden victims” at the beck and call of the apparatchiks of the ruling elite, whenever there is money and power to be grabbed.

Native Hawaiians and other Pacific islanders make up only 10% of the population of the state. How about federal representation? Would the “Natives” have their own senators and congressmen?

I can imagine huge problems with this. Among those issues are, that only a small percentage of Hawaii residents are of native Hawaiian ancestry. And there are many who are mixed Hawaiian and other ancestry. One’s ancestry or ethnic background is supposed to make no difference in America.

And how do you prove that you have adequate Hawaiian ancestry to qualify for this new government and benefits?

And what if you have native Hawaiian ancestry, but this idea doesn’t agree with your view that we all should have equal protection of the laws, under one set of law? Will you be compelled to be following the separate Hawaiian legal system, instead of the existing system covering everyone else????

Particularly telling that members of the US Human Rights Commissions (liberal appointees all) are upset about it— that’s internal democrat wrangling from the true believers. There was a Civil Rights Act, after all. Equal Protection and all that.

But rule by regulation and federal agencies apparently bypasses this under the “correct” apparatchiks. The Park Service head (under the Dept. of Interior also I believe) a real lefty, enforced banning our WWII vets from access to their own memorial— to make a political power point. So this is who these people are— unanswerable empowered bureaucrats elevated by the mack daddy lefties.

I wonder if they would set this up similar to how Indian reservations are set up? But then, Indians have separate geographic areas set up as their reservation lands. What areas of Hawaii would be the Hawaiian reservation? What if native Hawaiians don’t want to be part of a reservation?

Has anyone really thought through the implications of setting up such a system in Hawaii? This strikes me as something that someone came up with over a few beers in a bar, without thinking through exactly how this gets administered.

Not only that, but the wording of the HI constitution describes “native” as being “descendants” of the population people present at the time of Captain Cook’s visit in 1778.

This translates (with extreme stretching of genealogy) to a possible 1 in 500 chance of “probable” descent that is virtually unprovable, except for physical characteristics.
DNA from Queen Liluokulani— would that help establish the “race”?

I'm actually OK with that. As long as the race of people who vote for higher taxes and bigger government actually have to PAY for that mess. And the groups of people who want no part of it?

Leave us alone.
