Yes, that's if they wind up having discovery. But, being pessimistic about it, the hunch here is that the IRS will pull out all stops to prevent that from happening, and will lean on this Obama-appointed judge to see that it never does happen - at least as long as she is presiding over the case.
Of course, if discovery is denied, there may be some recourse for the plaintiff at the Circuit Court (appellate) level.
