Lurking Freeper needs advice(vanity)

It seems to me that investigating officer is on your side. We were in a similar situation a few years ago and the investigating officer was the most helpful person we dealt with. Yours seems to be as frustrated with the lack of prosecution as you. He is also the most knowledgeable person on the facts of the case.

Try to arrange a face-to-face meeting with him and get his advice on what to do. If nothing else, you might be able to file a civil case against the driver. You might even find a lawyer willing to take the case without cost to you, though he would get a significant portion of any settlement. That would work only if the driver has any significant assets. If the driver had insurance, they would likely pay up to the policy limit. Good luck. Sorry for your loss. I know how difficult it is.
