No objective lawyer who has been involved in eDiscovery the discovery during litigation of emails and other electronic documents will credit the Obama administrations claim that, by accident, years of Lois Lerners emails were irretrievably lost. John explained why here.
Moreover, as Bryan Preston at PJ Media reports, a former IRS IT specialist is equally skeptical. The individual in question worked on the IRSs contract with Computer Sciences Corporation to modernize the agencys digital record-keeping system. He finds it difficult to believe that the IRS could have lost two years worth of Lois Lerners emails.
He notes first that U.S. law, specifically 44 U.S.C. Chapter 33, requires that agencies must notify the Archivist of any records that are destroyed and the reasons for destroying them. In addition, federal regulations establish strict recoverability and redundancy requirements. Disposal of records outside these standards requires permission in writing.
The IRS satisfies these requirements thought Microsoft Outlook/Exchange systems, which are backed up using Symantec NetBackup. According to the IT specialist, IRS had some of the best people in the federal government charged with making sure these systems work as intended.
The IT specialist makes short work of IRSs claim that backup tapes were reused after some short period. He says the IRS had thousands and thousands of tapes and Virtual Tape Libraries (VTL or non-tape backups based on hard drive storage technologies). Thus, there was never a reason to reuse tapes. In any case, the U.S. government has been getting out of the tape backup regime for years.
The former IRS IT specialist concludes:
Those folks would not have had such a short retention period for email unless they had it in writing from the highest levels. It would have made the local IT water cooler gossip if the IRS had screwed up and lost tons of email by accident.
Many are comparing the Obama administrations claim that Lerners emails are irretrievably lost due to inadvertence to the claim that Rosemary Woods accidentally deleted 18 minutes of White House taped recordings. If anything, Team Obamas claim seems less plausible. At least Ms. Woods was able to stage a demonstration of how, conceivably, Team Nixons scenario could have occurred.
And while were on the subject of Nixons erasure of the 18 minutes, how does the New York Times non-stop coverage of that event compare with its coverage of the missing emails? The answer is theres no comparison because, as Roger Kimball tells us, there was no coverage by the Times of the latter at least not when the story broke.
Nixon: What did he know and when did he know it.
Obama: What didn’t he not know, and when didn’t he not know it.
Check with the NSA. Maybe they have a copy...(I’d bet every communication between Republicans on The Hill has been stored).
If they “recycle” backups, then they aren’t used to retain email long term. If they didn’t restore her system after the crash, then they aren’t for restoring systems either. What exactly are the backups for? Someones lying.
I hope House investigators have been dispatched. They will find the e-mails and or what happened to them and file the criminal charges as needed.
You talking about Holder's Justice Department conducting actual law enforcement against one of their own? C'mon.
how can we believe all of these IT experts when the WH spokesman says otherwise?
An expected quote from Boehner
Well, apparently, he doesn't know crap about crap until he reads it in the paper, assuming he can read at all.
So, was it just her emails or the entire office’s emails, that got “Lost”?
It’s entirely likely that tape backups were recycled ,, if they were used for incremental backups , however there are the full backups usually taken in weekly or monthly intervals that you generally restore from first and THEN apply the changes/updates from the incrementals..
The docs exist or were intentionally destroyed ,, and their destruction would have entailed the loss or spoilage of tens of thousands of other employees backups also.
For their story to be believable it affected at least the mail server(s) she uses and ALL the mail servers that would be on the recipients end(s). Basically ALL e:mail within the IRS and White Hut ,, not plausible.
Snowden prolly released a bot, a few months ago, to sniff around and copy/send back all of Lerners E-mails.
He knows when you are lying, he knows when you are truthfull.
Congress simply needs the IRS and Whitehouse to release those E-mails.
Heres the deal with the excuse of tapes being written over every six months. What happens. The tapes are loaded with data. Sent offsite. The offsite company copies from tape to their hard drives (virtual tapes). And the tapes are sent back to the company (IRS) and go into a tape library for restores, disaster recovery etc. After a certain period of time (6 months - 2 years) the tapes go back into production and are written over. But there is still a copy at the offsite facility on a virtual library.
Are they setting it up to use governmental incompetence (see Obama Care Web Site) as an excuse?
Another crime that this administration will get away with.
Benghazi. Fast and Furious. They got away with them, thanks to a public with its head up its anal passageway, and a compliant media.
Read “Gangster Government and Sakharov’s Immunity” to see how we arrived at this dangerous place, where the gangster media is part of the gangster government.
Since 2006, the Democrats have fundamentally transformed the United States to a RICO Banana Republic, where the M.O. of those in power is to do whatever they want, flip you off, and say "What are you gonna do about it?"
The Republicans are simply the neighborhood punks hanging around the mob storefront hoping to join the club, like in "A Bronx Tale."
Another sloppy cover up a teenager wouldn’t buy.
To me this excuse (lie) isn’t a smoking gun but an admission of guilt.
