[AP July 25, 2003 13 yrs ago] EPA in Contempt for Destroying Computer Files

It’s hard to hear about this week’s Environmental Protection Agency contempt case and not think about the controversies surrounding the IRS “loss” of Lois Lerner’s email–and hard drive–and crash of the relevant server.

According to an Associated Press report, a federal judge has held the EPA in contempt for destroying computer files sought after by a conservative group: Landmark Legal Foundation.

It’s taken more than 13 years.

U.S. District Judge Royce Lamberth had ordered the EPA on Jan. 19, 2001, at the end of the Clinton administration, to preserve all documents relevant to a Freedom of Information Act request by Landmark regarding the federal agency’s contact with outside groups. That same day, EPA Administrator Carol Browner asked a technician to delete her computer files. Browner later testified that she was unaware of the court order and simply wanted to remove some games from her work computer.

According to AP, EPA officials later admitted wiping clean the computer files from Browner and other top staff despite Lamberth’s order.

In finding the EPA in contempt this week, Judge Lamberth ordered the agency to pay Landmark’s legal fees. That means that ultimately taxpayers foot the bill for the EPA’s misconduct.

In his order, Lamberth said the EPA had shown “contumacious conduct,” or obstinate resistance to authority.

Browner was not held in contempt.

Wasn’t the EPA discovered to be using “private” (offsite) email addresses to coordinate attacks on political enemies?

Can’t make a freedom of information request without knowing all of the contact addresses used.

TRANSPARENCY fail.

After Klinton the Pubbies had control for a while and did their usual NOTHING! That tells all that the two parties are one and the same except for their lying monikers. The Power Elite must go, even if it takes guillotines.

The EPA didn’t destroy the files, individuals did.Why are there no charges? It’s just like the robo sign scandal.

abolish the EPA, IRS, NaSA and government schools for starters

government is the problem. the democrat party is the enemy . the democrat party owns the media and creates a false reality we all live in , “the matrix”. in this false reality gov is the solution to every problem and all the abuses of power done by Obama don't exist

Obama is using the EPA to destroy America. Barack Obama ordered the IRS to oppress conservative Americans and rig the election. Obama is letting in hordes of illegals blatantly. these are just 3 out of hundreds of abuses of power done by this marxist Obama, new ones being exposed (only on internet) ever day

impeach Obama. Obama must resign

why are we sitting down?

That was Lisa Jackson.

She quit "to spend more time with family" as soon as the House made it clear they were going to pursue this.

Games on her work computer. They must have zero IT standards or at least they bend the rules depending on who it is and their position and status. This is a major issue that plagues any organization getting public funds.

I was exposed to an environment like this at MD Anderson. The rules were not applied equally with technology. Different groups could get away with breaking protocol even to the point of violating federal privacy compliance. Its nice to know the agencies responsible for enforcing the rules show a total contempt for their own policies and procedures. Hypocrisy at its worst.

So this meaningless penalty is against the American taxpayer. The judicial system is not up to the task of corrective sanctions. We need serious individual penalties and jail time or nothing will change.

Lessay when YOU got pulled over on the highway you received a citation, kay?

And in recompense you simply paid the money of OTHER people from whom you confiscated —think you’d slow down...?

Or, after you didn’t pay a cent, NO ONE went to jail —would the highways be safe...?

Yet, that’s exactly what they want us to believe, here.

How about they have to cut, say, HALF of their payroll..?

“Games on her work computer.”

Interesting. I have been at NASA since 2000. I’ve never seen a government computer with a game on it.

It is incredible that a manager in the midst of an investigation would have a sudden compulsion to rid her system of computer games. Of course, that leaves the door open to coyly ask just how many computer games are on the EPA system for the EPA employees to play instead of doing their work?

The alphabet agencies claim authority from Congress who created them in the first place. They are mismanaged. At all levels. Nobody checks on them, Congress just reacts to the most severely controversial actions. And even then, there are no real penalties other than a congressional lecture or three. Nobody goes to jail or forfeits retirement or pays a penalty, even for the most egregious behavior.

Congress created these agencies; Congress needs to fix them - starting with A and going all the way to Z. But how to do it? Assign each agency an independent IG? So even the highest managers realize someone really is looking and favoritism can't insulate them? But there's still no penalty. So what to do?

It’s some weird sh*t that we haven’t seen any stories in Barry’s state controlled “media” about the ATF “accidentally” destroying or losing any files or “recycling” hard disks. That’s really weird. I’ll bet they are the only agency whose files are under heavy guard both day and night. Just dare to try to push the “delete” button and you’ll ended up being shot.

One of my nightly mental exercises while trying to fall asleep is calculating the loss of 4 or 5 DC Departments on the US economy. So far, the damage would seem to be 80% local.

Drain the DC swamp/jungle. Defund the bureaucracy.

Restore federalism. Return the states to the senate. As per Article I Section 1 clause one, all legislative powers granted belong to Congress, which means no regulation has force until congress and the prez sign them into law.

Defund the bureaucracy.

It's the only way. As it is now, (R)? (D)? Doesn't matter. In a great many ways, Bush was blindsided by the bureaucracy. His stupid spending did the rest. Having an (R)Congress matters nothing, unless we continuously clamor to reduce it and eliminate the filth.

Camp on their e-mail and tie up their phones day after day after day. Start getting in their arrogant faces and demand it.
