My take on it, no warning shots. You are responsible for every bullet. Don't draw unless it is life or death. If it is life or death, why are you taking chances? Why aren't you ending that situation as quickly and assuredly as possible? (ie shooting to kill aka immediately incapacitate) if you are giving verbal warnings and holding off on those shots, you are doing the perp a kindness he/she probably doesn't deserve.
Virginia is very clear on this. If you brandish, you had better be able to shoot. If no immenent threat, then keep it holstered.
Unfortunately, a guy got convicted of brandishing for shifting his gun from his holster to his glove box. It’s still on appeal, but in the meantime, he’s had his CHP suspended. A bogus decision, as he never pointed it at the bus driver who complained, but still on his record.
