National Archives boss: IRS ‘did not follow the law’ on lost Lerner emails
Fox News ^ | June 24, 2014

Posted on 06/24/2014 11:50:20 AM PDT by Olog-hai

The top U.S. official in charge of archiving federal records testified Tuesday that the IRS ran afoul of the law by neglecting to tell his office that a trove of emails from the woman at the center of the targeting scandal disappeared after an apparent hard drive crash.

Archivist of the U.S. David Ferriero, speaking before the House Oversight and Government Reform Committee, made clear that federal agencies are supposed to report whenever their records are destroyed or even accidentally deleted. But he said that after emails from embattled IRS official Lois Lerner vanished after a computer failure in 2011, nobody told the National Archives.

“They did not follow the law,” Ferriero said. …

So, what’s the penalty under the law, and to whom is it to be applied?

I think the answer is no one knows... so there is effectively no law and no penalty.

I’m turning 65. I don’t believe I’ve ever seen a bigger scumbag in my entire, short life than the current head job of the IRS. What an arrogant pr*ck. He reminds me of the arrogant old Nazi officers you see in war movies.

I can't tell you the s^%$ storm I'd be in if I pulled a stunt like that with official correspondence!

Yet somehow, government employees and officials are given the widest possible latitude and are forgiven the MOST incredible blunders (crimes, more like) BECAUSE they're employees of the government!!??

What a bunch of bungling and corrupt idiots!

The IRS and any other federal agency investigating a business or individual for breaking laws or even regulations would demand that they follow this law and wold be quickly prosecuting anyone who gave the lame excuse that they lost their records due to a computer crash. The IRS should be held to the same standard.

I have worked with Corporate and Government Security...including IT Security.

These people are lying...plain and simple.

The original emails, in government serice, were not on her computer...they would have been on a server. The server gets backed up regularly. The backups get archived regularly. Her own emails would be in two or three locations and have to be maintained for certain amounts of time...none of which had expired for her.

In addition...every place she sent an email within government does the same. So whatever she sent to the White House, or to Congresional reporesentatives, etc. are also backed up and archived.

What I believe has happened is that they sytematicall went through the servers and archives and deleted her emails. Once they were sure they had done that...then they concocted this story.

But there will be a trail of that activity in the audit logs that those servers maintain.

In addition, they will be able to recover most of it off the servers and the archives if they get the right computer foresnic people involved.

The Obama admninistrtion is a crininal conspiracy cabal. He (and they) are doing whatever they want, the law be damned, and the people in positions to do so are not standing up to it as they should.

I pray the Congress is waiting on a majority in the Senate so they can impeach and convict and then remove a whole bunch of these people. And then try and convict them in criminal court afterwards and have them spend a long ime in prison.

The House could have been impeaching Obama sixteen ways from Sunday this whole time...and should have.

Make THAT their business. Make THAT his legacy.

But I am not holding my breath.

Trey Gowdy is a smart prosecutor, but he is dealing with arrogant liars. The dims want this fight so they can claim the repubs are a bunch of bullies and are attacking a black led admin. This is going to take a lot of pressure on lower level types to get the truth out on this. NO ONE within close reach to Obama/Jarrett will cooperate on this.

Correct me if i’m wrong.

If a drive crashes it’s not like a tree falling in the forest. Bells go off everywhere and backups are immediately restored. You don’t just buy a new drive and continue like nothing happened.

Within hours the restoration should have taken place. If not, this is almost criminal negligence.

Oh, that's the best part, as far as they're concerned.

The fact that they can spit in the faces of the very people who pay their grossly inflated salaries is one of the greatest perks of their jobs. It fills them with delight.

A lot of white-collar criminals are arrogant liars.

If that was enough to thwart their prosecution, there wouldn't be very many of them in jail.

Yes. So true. Normally they would have immediately made sure the records were kept safe on the backups.

And guess who's behind these lies? Obama. He is fighting for his life here and he and his henchpeople are inventing this lying defense.

See at the linked YouTube video of the Monday night hearing (beginning at 1:50:30) where Rep. Chaffetz questions IRS Commissioner John Koskinen.

Koskinen admits ALL of Lois Lerner's e-mails were available on a back-up tape but were not extracted and saved because it was too much trouble.

Reps. Gowdy and Jordan may have been fun to watch, but Chaffetz got the Commissioner to make a much more damning admission.

I know I'm in IT also and this just does not happen

An IT person job is about the data..storing it, transporting it, processing it..and making redundant copy so one one event causes a loss .....drives are expected to crash..it factored in, redundancy is built is to protect the data. (backups and raid)...plus the simple fact that any one email must touch and be copy on a minimum of three ( likely four ) drives..sender, receiver and email server for sender and receiver

What their trying to sell would imply their IT practices are so amateurish as to be criminally incompetent

A lot of white-collar criminals are arrogant liars.

Anyone who has been around a Federal agency knows that lying is the default activity of management from the bottom to the top. In judicial or quasi-judicial proceedings you always have to hope that they have been stupid enough to compromise their lies.

really at this point my bet is their just foot dragging to play games.

This is lawyer BS...you get a request to turn over evidence...
so lawyer makes 5 piles of evidence

Pile 1 is irrelevant..you turn that over...
Pile 5 is incriminating...you destroy that day one.

But piles 2 to 4... that is that stuff that will not incriminate you but you do not turn over..its bait for misdirection. its rope for legal tug a war to distract

You use it to play the gaming going on now...
because you can fight over this or you can let go of the rope to let the opponent fall on there ass..

Make them fight for what you know is nothing to hide the something you already destroyed
