The top U.S. official in charge of archiving federal records testified Tuesday that the IRS ran afoul of the law by neglecting to tell his office that a trove of emails from the woman at the center of the targeting scandal disappeared after an apparent hard drive crash.

Archivist of the U.S. David Ferriero, speaking before the House Oversight and Government Reform Committee, made clear that federal agencies are supposed to report whenever their records are destroyed or even accidentally deleted. But he said that after emails from embattled IRS official Lois Lerner vanished after a computer failure in 2011, nobody told the National Archives.

“They did not follow the law,” Ferriero said. …

So, what’s the penalty under the law, and to whom is it to be applied?

I think the answer is no one knows... so there is effectively no law and no penalty.

I’m turning 65. I don’t believe I’ve ever seen a bigger scumbag in my entire, short life than the current head job of the IRS. What an arrogant pr*ck. He reminds me of the arrogant old Nazi officers you see in war movies.

In Texas-and probably in your state, too-up to about 100 years ago there are many cases of people like that arrogant prick being summarily dealt with by what is still called “frontier justice” out here...

Laws? Who needs laws? Laws are so Bourgeoisie.

We have front row seats to the birth of a communist nation.

I can't tell you the s^%$ storm I'd be in if I pulled a stunt like that with official correspondence!

Yet somehow, government employees and officials are given the widest possible latitude and are forgiven the MOST incredible blunders (crimes, more like) BECAUSE they're employees of the government!!??

What a bunch of bungling and corrupt idiots!

The IRS and any other federal agency investigating a business or individual for breaking laws or even regulations would demand that they follow this law and wold be quickly prosecuting anyone who gave the lame excuse that they lost their records due to a computer crash. The IRS should be held to the same standard.

I have worked with Corporate and Government Security...including IT Security.

These people are lying...plain and simple.

The original emails, in government serice, were not on her computer...they would have been on a server. The server gets backed up regularly. The backups get archived regularly. Her own emails would be in two or three locations and have to be maintained for certain amounts of time...none of which had expired for her.

In addition...every place she sent an email within government does the same. So whatever she sent to the White House, or to Congresional reporesentatives, etc. are also backed up and archived.

What I believe has happened is that they sytematicall went through the servers and archives and deleted her emails. Once they were sure they had done that...then they concocted this story.

But there will be a trail of that activity in the audit logs that those servers maintain.

In addition, they will be able to recover most of it off the servers and the archives if they get the right computer foresnic people involved.

The Obama admninistrtion is a crininal conspiracy cabal. He (and they) are doing whatever they want, the law be damned, and the people in positions to do so are not standing up to it as they should.

I pray the Congress is waiting on a majority in the Senate so they can impeach and convict and then remove a whole bunch of these people. And then try and convict them in criminal court afterwards and have them spend a long ime in prison.

The House could have been impeaching Obama sixteen ways from Sunday this whole time...and should have.

Make THAT their business. Make THAT his legacy.

But I am not holding my breath.
