The sleeper case that could bust open the IRS scandals
Th American Thinker ^ | 6-27-14 | Thomas Lifson

In the absence of a special prosecutor, the best opportunity for piercing the veil of secrecy and evasion that surrounds the IRS handling of groups perceived as enemies of the Obama administration lies in civil litigation. The National Organization for Marriage has just obtained a $50,000 settlement from the IRS for its criminal release of confidential donor information to an opposition group. ~snip~

The absence of any official judicial inquiry into the inner workings of the IRS processes is why it is so important to note that yesterday saw the beginning of the discovery phase in the lawsuit by Z-Street a pro-Israel organization that was told its application for tax exempt status was being delayed because:

…these cases are being sent to a special unit in the DC office to determine whether the organization’s activities contradict the Administration’s public policies.
Z-Street’s lawsuit alleges unlawful viewpoint discrimination, a First Amendment claim. The IRS tried several arguments to dismiss Z-Street’s lawsuit, all of which were dismissed by Washington, DC federal district court Judge Ketanji Brown Jackson, an Obama appointee. She noted that Z-Street was not suing to gain tax exempt status, but rather over the viewpoint discrimination evidenced by what it was told by IRS agent Diane Gentry about contradicting administration policies – the process by which the IRS made the determination on tax exempt status. In the words of the Jerusalem Post:

The Z Street case may be what forces the IRS to pull aside its carefully constructed curtain and reveal how it made decisions regarding organizations deemed out of step with the current US administration.

~snip~

Strangely enough no major media outlet covered the opening of the discovery phase of this case. Only Gretchen Carlson of Fox News had the wit to notice...

Yesterday Obama began a new defense against the actions of the IRS.

In a speech he claimed a few federal employees have made bone headed decisions.

” determine whether the organization’s activities contradict the Administration’s public policies”

Don’t buzz over this bit lightly, folks.

This is the IRS determining whether an organization gets a certain tax status based on its agreement or disagreement with the current Administration’s goals.

Think about that. Opposing communism, or opposing criminalization of Christianity, or opposing Islamic takeover of the USA, could “contradict the Administration’s public policies”.

From the article:
“The potential destruction of evidence, by becoming a separate tort, opens the door for judicial inquiry into the IRS destruction of evidence. Armed with subpoenas and able to examine and cross examine people under oath, Z-Street has the potential to bust open what really went on at the IRS.”

Here’s the thing, though: if these organizations that were the victims of discrimination all line up and file lawsuits, get settlements from the IRS, then WE will be left holding the bag for the cost of the settlements, and NO ONE in the IRS will be denied a penny of his or her pension benefits, nor will they spend any time worried about the criminal charges or jail sentences. There needs to be a multi-pronged offense to rid the IRS of corruption and criminals.

It almost looks like this administration intends to reward their supporters and punish their enemies.

MARK WELL “The IRS Conservative Targeting Scandal involves:

•Hundreds of conservative groups targeted
•At least 5 pro-Israel groups
•Constitutional-centered groups
•Groups that dared criticize the Obama administration
•At least two pro-life groups
•An 83 year-old Nazi concentration camp survivor
•A 180 year-old Baptist paper
•A Texas voting-rights group
•A Hollywood conservative group targeted and harassed
•Conservative activists and businesses
•At least one conservative Hispanic group

SUMMATION The IRS continued to target groups even after the scandal was expose. And… 100% of the 501(c)(4) Groups Audited by IRS Were Conservative There is NO EVIDENCE that a single liberal group went through the same scrutiny as conservative groups.”

The exhaustive compilation of IRS targets (above) presents an interesting roadmap to uncover the IRS' possibly Falsifying of Official Government Documents.....punishable by 10 year incarceration.

Falsifying Government Documents. involves altering, changing, or modifying a document for the purpose of deception.......can also involve forgery and/or passing copies of false documents. Falsifying documents is usually done in connection with broader criminal aims, such as extortion, government fraud, tax evasion, money laundering, financing terrorism........

Types of documents commonly falsified may include:
◾Tax returns and income statements
◾Personal checks
◾Bank account records
◾Business record keeping books
◾Immigration documents (such as visas, passports, etc.)
◾Identification cards and birth certificates

Many different types of acts can be considered as falsifying a document, including:
◾Altering or misrepresenting factual information such as prices or monetary amounts
◾Stating false information when requested to provide truthful statements
◾Forging a signature
◾Using official letterheads without authorization
◾Concealing assets or property WRT obtaining federal/state grants))
◾Knowingly using or distributing a fake document

A person can only be held criminally liable if they are deliberately acting with the intention of deceiving or defrauding another party.

Falsifying documents is a very serious offense and is generally classified as a felony. This means that a person charged with falsifying documents may be subject to the following legal penalties:
◾Having to pay a monetary fine
◾Incarceration in a prison facility

Depending on the gravity of the offense, as well as individual state laws, falsifying documents can result in a prison sentence of 5-10 years. Also, if government documents or authorities were involved, the legal penalties may be more severe. ..... legal penalties may increase with repeat offenses.

The penalty for falsifying government documents is outlined in the Crimes Act of 1958.

I certainly didn’t. I consider it the money quote from the article. For them to actually say that means they are restricting free speech based on the content of the speech.

That is a huge no-no in this particular constitutional republic.

This morning in an interview, John Fund stated that congress would have way more success in issuing subpoena’s to hundreds of IRS employees, he said hundreds, get them under oath and start asking questions. He claimed they won’t all lie, some will be approaching retirement after 30 years and numerous Presidents and just may spill the beans.

The sleeper case that could bust open the IRS scandals

The IRS is just the most visible of the dictator's use of government agencies to further his political agenda. I suspect that there are many other agencies that the 0bama regime has used to "punish" conservatives - we of course witnessed the BLM's attempts at the Bundy Ranch. I suspect other agencies such as Social Security and even contract agencies like the TSA - all united to advance der 0berFuhrer Baraq Hussein 0bama's agenda!

IMO the corruption in the IRS and other federal agencies is far worse than even most pessimists imagine.

It is so bad that I also believe there is no realistic “legal” recourse because the corrupted people and agencies so completely permeate the entire federal system.

I see three ways this could go:

1) As it is now, and continuing to get worse until the police state is so bad we resemble a Soviet bloc country. (most likely scenario)

2) The media in mass turns on the criminals in government, especially Herr Leader, and goes after him as they did Nixon until they destroy him (nearly impossible)

3) A sufficient number of Americans finally resort to massive civil disobedience, which would likely evolve into violence and extreme government crackdown (possible, extremely unlikely)

If we had a real opposition party I would add a 4th possibility to this list. The Republican Party is nothing more than a dog and pony show. Means nothing, changes nothing, will change nothing.

I recently began to sway my opinion to believe this may all be an intentional ‘scandal’ perpetrated by the RATs. This is not my first comment to that effect. Every day that goes by, I see headlines, and no consequence...nothing that can’t just be asserted “it was just these 2 employees” BS. I’m very suspicious that the ‘missing emails’ will be ‘found’ and they will reveal nothing, with hindsight analysis demonstrating that the key players in this were likely actors in a grand theater performance. Time will tell.

I think it’s important to sometimes take a devil’s advocate view and at least consider the alternatives because, frankly, this has all the appearances of one grand manipulation...being played to someone else’s fiddle...

Thanks for the reminder, videotaped quote provides legal proof of "intent".

This along with Lois Lerner’s e-mail asking for an audit of Sen. Grassley without any evidence of any wrong doing shows the blatant political targeting at the IRS.
