The Obama administrations just-released criminal complaint against the alleged mastermind of the Benghazi terrorist attacks provides a final contradiction to its own evolving explanations for what happened that day.
The Justice Departments indictment spells out a calculated conspiracy by Ahmed Abu Khatallah and associates to attack the U.S. diplomatic mission and CIA annex, which killed four Americans. The indictment might be viewed as a death knell for a theory that the attack resulted from a spontaneous protest against a U.S.-produced video.
Now in custody, Khatallah was a commander of Ansar al-Sharia in Benghazi, a U.S.-designated terrorist group, and is himself deemed a global terrorist by the State Department.
But with the capture of Khatallah in June, the Justice Department is characterizing Benghazi not as the impromptu work of a mob but as a conspiracy hatched by terrorists who had infiltrated the port city in eastern Libya.
The unsealed June 26 indictment, coinciding with Khatallahs U.S. District Court appearance in Washington, states that the grand jury does not know when the conspiracy began. It says Khatallah did knowingly and intentionally conspire and agree with other conspirators, known and unknown to provide material support and resources to terrorists, that is personnel including himself and others.
The indictment says Khatallah intended the material support and resources to be used in preparation for and in carrying out the attacks that killed the ambassador, his aide and two ex-Navy SEALs protecting a CIA base that came under precision mortar attack.
The laying out of a conspiracy charge marks a major move away from assertions early on that a video and a spontaneous crowd caused the four American deaths.

"On June 26, 2014, a federal grand jury in this district returned a one-count Indictment charging the defendant with Conspiracy to Provide Material Support and Resources to Terrorists Resulting in Death, in violation of 18 U.S.C. § 2339A. Specifically, the Indictment charges the defendant with conspiring to provide material support and resources to terrorists, knowing and intending that the support and resources were to be used in preparation for and in carrying out a violation of 18 U.S.C. § 930(c) (killing a person in the course of an attack on a federal facility involving the use of a firearm and a dangerous weapon) and a violation of 18 U.S.C. § 844(f) (maliciously damaging and destroying U.S. property by means of fire and an explosive). The charged offense, which carries a maximum penalty of life in prison, see 18 U.S.C. § 2339A, is a crime of violence, as defined in 18 U.S.C. § 3156(a)(4). See United States v. Goba, 220 F.Supp.2d 182, 187 (W.D.N.Y. 2003) (conspiracy to provide material support to foreign terrorist organization constitutes a crime of violence). The charged offense is also listed as a Federal crime of terrorism in 18 U.S.C. § 2332b(g)(5)(B). An immigration detainer has been issued for the defendant by the Department of Homeland Security."
"As discussed further below, the defendant is an approximately 43-year-old Libyan national who conspired to participate and participated in the Attack that ultimately resulted in the death of four Americans and the destruction of U.S. property.
"In particular, the defendants participation in the Attack was motivated by his extremist ideology. The defendant was a commander of Obaidah Ibn Al Jarrah, an extremist brigade that was absorbed into Ansar Al Sharia (AAS) after the recent Libyan revolution. AAS is an Islamic extremist militia in Libya that holds anti-Western views and advocates the establishment of Sharia law in Libya. The United States Department of State (DOS) designated AAS in Benghazi a Foreign Terrorist Organization on January 10, 2014. The DOS noted in its designation that AAS in Benghazi has been involved in terrorist attacks against civilian targets, frequent assassinations, and attempted assassinations of security officials and political actors in eastern Libya as well as the Attack. The defendant, who is a senior leader of AAS in Benghazi, was also designated by the U.S. government as a Specially Designated Global Terrorist."
The regime pissed on the 1st Amendment for no good reason — not to suggest there could ever be a good reason.

Why is an Unlawful Enemy Combatant being put on Trial in the United States? He does not share the same Constitutional Protections and Rights that a United States Citizen enjoys.
Oh sorry, everything is different now that a Mulatto Marxist is running the show. He can’t be criticized because he is a Mulatto, which makes his Marxist ideology untouchable as well.

How do you charge a foreign national, acting on foreign soil, with crimes against U.S. law? Are all foreigners now charged with understanding and complying with our statutes? Are we chargeable with understanding and complying with theirs? I must say that law is a very inscrutable subject, difficult for someone like me, who thinks logically, to comprehend.
Where’s the criminal complaint against Rice and Hildabeans for their LIES?
So does this mean we can chide liberals now about this being the “Weapons of Mass Destruction” claim that Bush touted, as Obama’s dumbarse statement of his presidency???
You know, kinda along the lines of his Dad’s “No new Taxes” line???
Man, I love the potential yield this has, politically speaking of course...;-)
“unsealed June 26 indictment”
Why are we “indicting” an enemy combatant, treating him like he has rights under our laws?
He and his buddies are trying to destroy our society and its laws.
I thought for sure that somebody would waterboard that bastard until he came out shouting to the treetops about how the video made him do it and it was all the evil video.
