-- Every member of Congress swore an oath to preserve, protect and defend the Constitution of the United States. So did President Barack Obama. But too often over the past five years, the President has circumvented the American people and their elected representatives through executive action, changing and creating his own laws, and excusing himself from enforcing statutes he is sworn to uphold -- at times even boasting about his willingness to do it, as if daring the American people to stop him. That's why, later this month, we will bring legislation to the House floor that would authorize the House of Representatives to file suit in an effort to compel President Obama to follow his oath of office and faithfully execute the laws of our country. The President's response: "So sue me."

Talk, talk, talk. Same ole “stuff”.
Why sue? Can’t he just be arrested for criminal acts?
too much talk and not enough action
A-hole should have sued him 5 years ago. Charade.
“Cant he just be arrested for criminal acts?”
Probably no. Maybe if he shot somebody and there were witnesses, but even that’s unlikely. All of the enforcement arms report to him. He must be impeached by the House and tried by the Senate. Democrats would, who are in the majority in the Senate, would not vote to impeach even if he was stark-raving guano crazy. (In contrast, principled Republicans voted to impeach Nixon. When was there last a principled Democrat?)
Can he be arrested? Can the president be arrested if he commits a crime? I don’t know. I’ve always heard the only legal remedy is the impeachment process. Any Freepers who know please weigh in.
Tan Boy Boehner at his best here. Firing up the Dems and not using big enough ammo to actually accomplish anything.
It’s been all talk and no action up to this point.
After November it will be back to business as usual.Boner will do nothing but cry from time to time.
The lawsuit is a GOPe fig-leaf.
- It is fake opposition for the low information voters.
Why is Boehner still in this position?
No legislation is needed. There is already a court sitting empowered to deal with this.
It's called the House of Representatives, and John Boehner runs it.
Boner passed the Bar Exams donchyaknow. Can bartendars sue pResidents? Bammy’s a constitutional lawyer so they say-— or did they mean liar?
Go get him pink tie Boner while your gavel gently weeps.
Is this a joke or what!
“This will get the base off my back for a few years”
He won’t have any standing in the court and his lawsuit will get thrown out.
Nice grandstanding, Boehner!
Bone head has been talking this to death. Will someone please tell this asshat to do something about the border surge of illegal aliens?
Wooden cigar store Indian moves!
What sort of minute critter crawled inside the wooden cigar store Indian’s alimentary canal, to make him do this?
Why NOW? Why not MONTHS AGO?
Copyright restrictions apply down thread as well. Thank you.
That’s what they do: talk. And it seems to work for them. The ability to distract, confuse and dissemble are key success factors for politicians. Just saying.
Is this a joke or what!
Boehner and his merry band of clueless clowns in the GOPe are the joke. But their schtick seems to be working for them. They keep getting re-elected.
And Lynn Westmoreland (R, GA-3) supports this imposter. It makes me wonder what dirt they collected on Lynn back when he was a Conservative.
Stunt and UTTER waste of time and money. Won’t even get to SCOTUS for years.
GOPe trying to appear relevant and desperate for our vote.
Hey, Boehner, any comments on the southern invasion?
Or on our Marine still stuck in a Mexican jail?
Flaccid Boner is a joke. Do something, you freak. Maybe cut-off funding for Clown Prince nobama’s BS. By law that is something you CAN do...but won’t. Boner is flaccid.
More like ALL talk and NO action.
Yeah, and if Obama keeps it up, Boehner’s gonna write another letter!!
And Obama better not get him mad again, or Boehner will write a letter again, and after that, look out!! Boehner’s really gonna write a letter, man.
Eric Holder will get right on that.
“Why is Boehner still in this position?
Because politics is like a pond: the scum rises to the top.
impeach or STFU and go cry in the corner John.
Obama and Boehner are both members of that predominant, resident tribe running Washington, DC the Sosuhmee
Sir, the following is a quote from “Answers”:
..............”Nixon resigned to avoid being impeached; the Judicial Committee of the House had already agreed to it, and it looked likely that the Senate would convict him if the impeachment went ahead.”.............
You are partially correct though. Several Republicans met with Nixon and not only told him he would be “convicted” if impeached but that many republicans would vote for it including the ones sitting in front of him at the meeting. Contrast that to the scum Democrats today who quite literally would not vote convict Obama if there was a video of him committing murder.
1. Impeachment (gutless reps ain’t going there)
2. Power of the purse (gutless reps gave it away)
3. Article V (launched and ongoing; gives hope)
You nailed it. It’s all legal theory, full of wind and piss, signifying nothing.
Contrary to all these posts below, I think this might, finally, accomplish something by way of reigning in the tyranny from the Oval Office by the Great Pretender. Why don’t we see if there is actual follow through.
Geeze, cry me a river.
Besides drinking and maintaining his orange tan, all Boner did for the last 5 years is maintain a firm grip on his ankles and look up between his legs as the Kenyan mistake raped him and usurped more and more congressional power.
What did you de-fund, Johnny Boy? What did you present as a reasoned response to insane executive orders? Nada.
So now you want to snivel and sue. We’ll believe it when we see it. For now, you need to be content with your place as the second turd in the American punchbowl behind the Kenyan communist. May you soon circle the drain together.
“Why is Boehner still in this position?”
Because once you have your head stuck in there it’s hard to get it back out.
Hmmm. It took about three seconds for the usual crowd to show up and tell us this will never work, all is lost...
Actually, I think it’s pretty creative and even if it doesn’t work - and Boehner seems pretty committed to doing it - it might get a glimmer of press attention.
Keep playing for time, crybaby.
If you’re not implicated in something dishonest or illegal, and covering for the Disaster in the Oval Office, I’ll eat my shoe.
They can cut off the money, the only real power the have, but it is a biggie, but they refuse to do it.
How about the day after the election, in November?
Spaghetti for parachute chord is creative as well, and it definitely won't work. Neither will Boehner's stunt.
Ah, the stunt meme. How much are the Dems paying for this one? Not to get personal or anything.
But if you’re sincere, do you have a better idea?
You have to fight with the army you have.
I'm no expert on such matters. But it's pretty clear to me that "high crimes and misdemeanors" are political crimes. There is a special provision in the Constitution Article II, Section 4 that stipulates that such political crimes are to be tried in the Senate. Not in the federal courts. This process is called "impeachment."
The House must bring the articles of impeachment, as a sort of grand jury; the Senate is where the case is tried. Only the Senate can convict.
So, why on earth does Speaker Boehner seem to be evading the clear Constitutional language here? Rather it seems he is trying to prosecute the President in the federal criminal courts instead of following the constitutional provision for such matters.
The federal courts are not constituted to handle "political crimes." Moreover, it is dubious that Boehner or Congress would be found to have "standing" in this matter under the rules of the federal criminal courts.
I hate to say it, but the GOP seems to like to evade the Constitution as much as liberal Democrats do. At least every now and then.
But I think Boehner is definitely barking up the wrong tree; and I'd like an explanation as to why.
Impeach, convict, then arrest for criminal acts. Successor Biden pardons. Useless when the tyrant is immune.
the time frame was planned to take longer than the rest of Obama’s term. We can wait to see if it works though, because it won’t and BOner won’t do anything anyway.
