Court rules 'dreamers' can get Arizona driver's licenses

Calling the state policy motivated by animosity, the 9th U.S. Circuit Court of Appeals on Monday ordered that “dreamers” who the federal government allow to work in this country also be issued Arizona driver's licenses,

IIRC you need to show some kind of ID to vote. But they accept even electrical utility bills so I think they need to accept driver’s licenses also.

The court’s ruling is obscene but the article is disgusting too. Even by their own definition, “dreamers” aren’t simply workers that Obama allowed to stay and work in the US via his illegal executive orders. The media uses every propaganda tool to prop up the complete undermining of US sovereignty.

“Dreamers”, as if they are just kids with a dream of getting ahead. They most likely are adult male felons dreaming of driving around looking for someone to rape or rob.

Arizona should order all employees to ignore the judges ruling. The governor should state with firmness that the judges ruling is against the Constitution.

I truly HATE these evil leftist judges. They are black-robed tyrants. If our Founders were alive they would most certainly drag these evil tyrants out of their seats and bring them to the nearest tree.

The damage being done by these evil black-robed tyrants will destroy our Republic.

If the the 9th U.S. Circus Court of Schlemiels can nullify a state policy based on their determination that it is motivated by animosity, then the rest of us can ignore everything the 9th decides based on our determination that they are motivated by something far more sinister than mere animosity.

Actually, the SCOTUS has *never* found that the president is superior to state governors. Therefore, Brewer could refuse to issue these licenses on the grounds that these people are not recognized as citizens of Arizona, even if they are allowed to be in the US.

As a sovereign state, Arizona does not have to issue licenses to non-citizens. That it currently does to *some* citizens should be stopped before this travesty is allowed.

Brewer should appeal. Sadly she must do so to the 9th Circuit as a whole, first, before it can be appealed to the SCOTUS.

But if the 9th Circus refuses to stay the order, AZ may be able to appeal to the Supremes. IIRC they have been issuing stays on the Obamacare abortion pills mandate

DL are STATE law not federal. And there is not federal law either - “dreamers” are by executive decree not law.

These judges think “lack of nice intent” justifies throwing it out? Every doctor could have 0bamacare fully negated when conservative judges apply this same asinine argument.

Fine. Issue them driver’s licenses which are much larger than the standard license 4” x 4” and which state on them clearly, “non-citizen, non-resident alien” with the added verbiage, “The holder of this license is not eligible to vote in the United States.”

Could you please provide the information confirming FL allowing illegals to practice law. I heard another state, California I think, did that. But back in March, the Florida Supreme Court denied an illegal license to practice law in the state. If something has occurred to overrule the FL Supreme Court, I would like to see it.

Agree. The issuance of state driver licenses is subject to various state laws.

After having FL driver license for 35 years, I recently had to show a US birth certificate to renew.

As you said, AZ should refuse, it would violate their laws.

I had to show proof of citizenship to get my AZ license 2 months ago. I used my US passport. My wife had to show proof of permanent residency. This makes me think that the DMV will drop these requirements after this decision, but who will make that order?

We’ll see how it plays out. My wife was not allowed to apply for voter registration at the DMV. I was allowed to apply with my US passport.

The Federal Gov’t set new standards for State Drivers Licenses via the Real ID Act. If the States don’t meet the requirements, residents of that State cannot use a drivers license as ID for domestic flights. The court’s decision violates the Real ID Act because it forces the State of Arizona to violate the new standards. Starting January 2015, Arizona residents will need a Passport to board a domestic flight.

Please consider the following constitutional problems concerning "government" power to dictate driver's license policy in the context of immigration. To begin with, as mentioned in related threads, and politically correct interpretations of the Constitution's uniform Rule of Naturalization aside (Clause 4 of Section 8 of Article I), the states have never delegated to Congress, expressly via the Constitution, the specific power to regulate immigraton. This is evidenced by the following excerpt from Thomas Jefferson's writings where he clarified that fact in terms of the 10th Amendment nonetheless.
“4. _Resolved_, That alien friends are under the jurisdiction and protection of the laws of the State wherein they are: that no power over them has been delegated to the United States, nor prohibited to the individual States, distinct from their power over citizens. And it being true as a general principle, and one of the amendments to the Constitution having also declared, that “the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people,” the act of the Congress of the United States, passed on the — day of July, 1798, intituled “An Act concerning aliens,” which assumes powers over alien friends, not delegated by the Constitution, is not law, but is altogether void, and of no force [emphasis added].” —Thomas Jefferson, Draft of the Kentucky Resolutions - October 1798.

And since the states have likewise never amended the Constitution to grant Congress the specific power to decide driver's license qualifications, the 10th Amendment also automatically reserves such power uniquely to the states, not the feds.

In fact, the Supreme Court has clarified about the 10th Amendment that powers not delegated by the states to the feds expressly via the Constitution are prohibited to the feds.

”From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added].” —United States v. Butler, 1936.

The bottom line is that the idea that the feds can regulate drivers licenses based on constitutionally nonexistant power to regulate immigration begs the question as to where some judges went to law school.
