EPA Claims It Has The Power To Garnish Wages Without Court Approval

The Environmental Protection Agency has quietly claimed that it has the authority to unilaterally garnish the wages of individuals who have been accused of violating its rules.

According to The Washington Times, the agency announced the plan to enhance its purview last week in a notice in the Federal Register. The notice claimed that federal law allows the EPA to "garnish non-Federal wages to collect delinquent non-tax debts owed the United States without first obtaining a court order."

....and they promise to garnish Democrats and Republicans equally.

Wait....many Democrats don't have wages?

Someone, PLEASE tell me that a revolution is close at hand.

By-the-way, thank Richard Nixon for the EPA.

Actually, the EPA has always had the power to take everything you have if you have violated the rules/regulations.

I recall that being one of the lessons they touched on when I received my EHS Degree. That the EPA can come after the company, which is what they usually do for the deep pockets, but they can come after the individual as well.

And if you want to really get freaked out about the agency’s ability to do this...consider if someone contaminated some land, sold it to you, you sold it to someone else and decades later they ‘discover’ the contamination. You and everyone in the chain-of-custody can be held liable.

All without ever having to set foot in a true court of law.

Have a great day now!

If an obscure government agency can destroy a football team over its name, then certainly, ANY government agency feels it has the right to take your money.

The Federal Government is out of control.

Maybe FR could organize a contest for the most creative feedback delivered to the EPA... anyone game?

Better start sending in those comments...

I went to the EPA page, but couldn’t find where we can comment on this.

If someone know the link could you please post where we can comment on this specific plan.

The EPA must be defunded immediately. Then a move to reorganize the EPA. A better use of America's resources must be the primary function with the people usage first most.

Can 'we the people' fast track our own rules and cite some arbitrary date in which objections must be made by? If so, instead of garnishing wages, I'm making the following rule; all forms of taxation are no longer compulsory and will instead be treated as philanthropic gestures which must be acknowledged with a hand-written 'thank-you' note, signed by all members of Congress . All objections to my rule must be sent by certified mail, to my home by 12:00 noon, today.

In the beginning the EPA did good stuff by cleaning up rivers esp. the East River in New York. For the first time there’s fish in it. It grew into the monolith it is today under Democrat rule.

Here's the actual Federal Register notice, which includes instructions on how to send comments on the proposed over-reach/rule:

And of course, federal wages are exempt. Anyone surprised?

So much for the concept that the government exists to serve the citizens.

These people see themselves as Royalty and Masters Of The Universe.

They are the Americas Kings, Queens, Lords, ladies and dukes and we are their pesky serfs.

The entire federal government (and most state governments) need a good flush and a scrub with a steel bore brush.

Maybe lye or sulfuric acid would be strong enough but I doubt it.

Dunno about if they have their own “army”, but the taking of money is far easier than taking territory.

Money can be grabbed by a document and some computer keystrokes.

Territory on the other hand.....

How about a wholesale violation of the doctrine of separation of powers.

Here the executive branch (article 2) performs an article 1 function and, in effect, legislates. It then reverts to its article 2 role and prosecutes. Then it assumes article 3 status and conducts a hearing to determine guilt or innocence. It continues in that role as it imposes a fine. It then reverts to its article 2 role and concludes that it will garnishee wages in payment of the fine which it has imposed after a hearing which it has conducted in an article 3 role.

Of course I recognize that there are administrative hearings and administrative prosecutorial actions but what I am complaining about is the consolidation of all these roles in one unelected, unresponsive bureaucracy which is increasingly being improperly used in substitution for legislation. Presumably, legislation is more receptive to the will of the people than regulations fashion by anonymous bureaucrats but the absence of such legislation, which has been defaulted to bureaucrats, actually represents the will of the people that no action should not be taken.

The article 5 movement contemplates as one of its reforms an amendment that says that regulations that are not affirmatively ratified by Congress within a specified time period automatically become null and void.
