Actually this is POLITICAL SPEECH (and vandalism, too), but NOT a hate crime.
If you want to know why conservatives have a problem with hate crime laws, you can see it CLEAR AS DAY here...the laws GET ABUSED on a daily basis, in many, many, different ways.
