Brothers who forced five friends to have sex with each other before shooting them... (hate crime?)
Daily Mail ^

The Kansas Supreme Court on Friday overturned the death sentences of two brothers convicted of killing four friends who were robbed and forced to engage in sex acts before being shot to death and left in a snow-covered Wichita field.

The court also struck down three of the four capital murder convictions each against Jonathan and Reginald Carr, citing procedural problems at the brothers' joint trial for its decisions. It upheld one capital murder conviction for each of them.

Prosecutors said the brothers broke into a Wichita home in December 2000 and forced the five people there to have sex with each other and later to withdraw money from ATMs. Two women were raped repeatedly before all five were taken to a soccer field and shot while they were kneeling. Four of them — 29-year-old Aaron Sander, 27-year-old Brad Heyka, 26-year-old Jason Befort and 25-year-old Heather Muller — died.

Prison for life and they WILL get the same treatment that they dealt to others: living hell.

I would prefer NOT to house and feed them for eternity and gas'em, hang'em or zap'em.

We should learn from these poor victims to NEVER submit to armed kidnappers. Much better to die on the spot than put yourself at their mercy. Throw yourself at them immediately, before they have a chance to even comprehend that you are not going to submit. Go down fighting. You might even win.

Yes, he does.

These folks were in their own home, there was never a mention of firearms, except the ones the perps brought with them.

Reading the details makes one sick.
Similar type of hate crime happened in Nashville.

Looks like prosecutors are to scared to apply hate crime charges to criminals who are black. Darn shame. Victim’s family need to make it happen.

Because the majority sitting on the KS Supreme Court (appointed by Kathleen Sebelius) would rather KS abortionist George Tiller keep on killing unborn babies for the convenience of their mothers or to cover up incest and rape of underage sisters until one of them begged her teacher to protect her from another abortion, than find just punishment for these mad dog killers for their savage murder of innocent young college students.

I know that. I didn't say shoot them. I said throw yourself at them. In this case you may have been killed, but the rest of the party would have been spared because at that point the perps would be running for the hills because they had lost control of the situation.

Allowing the perps to maintain complete control didn't work out too well, did it? Kidnappers are very bad people. Very few kidnap victims come out of it alive. Never go with kidnappers. Do whatever is required to remove control of the situation from them, if you possibly can.

This is insane, why overturn 3 capital murder convictions because of a minor procedural error during sentencing? They were found guilty of four murders and attempted murder before the error occurred. WTF is happening in this country? Has every govt institution lost its mind?

So do I, and so would I, but they didn't. All they had was the element of surprise.

Problem is, these were normal, non-evil people. Normal, non-evil people don't understand or recognize evil people.

All I am saying is to learn from the misfortune of these innocent people that complying with kidnappers does not work out well. This was five against two. If they had all agreed beforehand that if something like this ever happened to them they would all jump on the perps at once, things would have turned out very differently. These guys would never have expected resistance, and may have been taken down like the cowardly scum that they are.

Just decide never to be a victim. That's the personal decision I've made.

Such utterly useless and dangerous animals need to be culled from the gene pool and culled quickly. They add nothing to humanity and their very existence involves huge costs.

The sad thing is that there are many animals such as these two “in the wild” and reproducing adding more generations with which we must contend.

The important response by the governor and legislature of Kansas is to make two important changes to the composition of the supreme court.

Currently the court has five lawyers, who are selected by other lawyers, and four non-lawyers who are selected by the governor. Obviously this process is flawed and needs to be replaced.

Otherwise, the governor and state legislature should pass a law authorizing the use of the firing squad as a means of execution. It is much harder to legally challenge, requires no special chemicals, and is inexpensive. Any LEO in the state could fire one of the rifles.

Kansas Supreme Court
Seated left to right: Hon. Marla J. Luckert, Hon. Lawton R. Nuss, Chief Justice; Hon. Carol A. Beier.
Standing left to right: Hon. Dan Biles, Hon. Eric S. Rosen, Hon. Lee A. Johnson, and Hon. Nancy Moritz.

I tried to read one of these decisions by this group of "judges"...what a mess.

So many "concur in part and dissent in part" so that NONE of them, it seems, wants to take full responsibility for not holding these monsters accountable for their crimes.

One part of the decision reads like this...

....the defendant's conviction for penile rape of a victim immediately after digital rape of the same victim rests on unitary conduct and must be reversed as multiplicitous.

Is that accurate?? Are they saying "digital" and "penile" rape are the same thing? And one cannot be prosecuted for both?? Or am I reading it wrong?

Here is a link for the more "legal eagles" among us, if you want to try and decipher it...

Kansas Supreme Court LOUSY Decision

http://www.kscourts.org/Cases-and-Opinions/opinions/SupCt/2014/20140725/90198.pdf

Bottom line, for me, is that the Kangaroos here were anxious to "unconvict" already convicted murderers.

We have judges these days who desecrate the intention of the U.S. Constitution's 14th amendment, while at the same time shredding the institution of marriage--and other judges who are chomping at the bit to disallow the conviction of murderous thugs.

Our Owners run the Crimnel Jesters system. They just want you to know that it's all completely arbitrary and a laugh-a-minute jest for them, and there's nothing you peasants can do about it.

Now, if these pieces of excrement had killed people related to the Owners, they'd have been cooking in Ol' Sparky so fast it would have made their heads spin.

However, their victims were just ordinary peasants, so the Owners will make mock of the families with this sort of claptrap.

I was thinking the same thing. Five victims, two perps ... Why did they let these animals do that to them? I think the answer is that you must fight back immediately, while the adrenalin gives you some edge. But we’re taught to submit, to hand over the wallet, to be a good compliant victim. We need to change that.
