WICHITA, Kan. The Sedgwick County District Attorney is alleging that a foster father was high while a baby was left in a hot car last week. She later died.
Sedgwick County District Attorney Marc Bennett read the allegations during a bond reduction hearing for Seth Jackson on Friday afternoon.
Bennett said that Jackson had run out of marijuana on the morning of July 24. That afternoon, he reportedly took two children to meet with his drug dealer where he bought more.
When he got home, Bennett said he left the 10-month-old girl in the car, went inside and smoked marijuana. He didn't realize the child was still in the car until more than two hours later, but she was already dead.
Since he believes Jackson was high on the day she died, he supports the higher bond amount. Even with the first degree murder charge, Bennett does not feel Jackson is a flight risk.
Jackson can be free on a $50,000 surety bond. Jackson's attorney, Les Hulnick, told KAKE News this is the first he's heard of the marijuana allegations. He also called the first degree murder charge "ludicrous." He expected Jackson to bond out of jail before 5 p.m. Friday, but as of 10 p.m., his bond still hadn't been posted.
Jackson's adopted children are now in state custody. Other children he and his partner were fostering have also been removed from the home.
Department for Children and Families Secretary Phyllis Gilmore released another statement following Friday's developments:
Should the allegations prove to be true, I am appalled that a precious, helpless child suffered such an unthinkable death while her foster parent was allegedly using drugs. We expect parents to protect and care for their children. We expect even more of our foster parents. They have a duty to put the children in their care before themselves always and provide a loving, safe environment. This incident is a rare exception to the otherwise strong record of foster care safety in Kansas. Drug use is not tolerated among our foster parents.
In the one photo I saw, the kids were white and blond. A least two pretty little boys.
_____________
if white and adopted or fostered over the age of 18 months , they get federal aid. and almost as much money. Surprising that the children were photographed.
Common in the ghetto in general; money for the kids is spent by the parents.

They are
But I was ridiculing the dope advocates’ “arguments” they’ve been regurgitating ad nauseum for decades
The purpose of dope is to get high, that’s it. Not everyone drinks to get drunk. In fact, by far most don’t. So to those trying to equate the two, no such luck.
What’s weird is that I think a lot of the people who want to outlaw cigarettes are fine with marijuana. At least, they seem to be in the same crowd. What IS that, anyway?
Is there only two choices? Always or never? That’s a logical fallacy. Non sequitur.
Lets legalize mj in more states. For the children... /s
The neighborhood they live in is NOT a ghetto. It’s not the wealthiest ‘hood in town, but not the worst, either. Their block sits next to one of the biggest and nicest protestant churches in town so whose to say they don’t go to church? Many of the gays DO go to church.
Whose to say he was high at the time the child died? And what about his partner? The partner isn’t accused, yet the partner spaced out the kid, too and he’s equally responsible for the welfare of all the kids. Even the other kids in the home spaced out the baby, and kids are usually on top of stuff like that.
I think they overstated the charges so that the Jury will convict on a lesser charge..the one they actually do want.
Florida, last I heard.
“The purpose of dope is to get high, thats it. Not everyone drinks to get drunk. In fact, by far most dont. So to those trying to equate the two, no such luck.”
As one who has done both, but now does none, I assure you that often a person does NOT intend to get “high” on either one, but sometimes does.
With mind altering substances, it is the risk factor that causes damage to self, and more importantly to others.
The overwhelming majority of drunk driving deaths don’t come from the intention for it to go that way.
I do equate them. Plenty of people can use drugs, and drink, “recreationally.”
And sometimes they can’t. And a certain fraction of society can do neither consistently “recreationally.” They drink/drug to excess.
That is not even touching on a huge problem: elderly on prescription pain meds, whacked out of their minds, and some of them driving.
The drinker of course is a good moral being, the illicit drug user an evil rebel. But what of the elderly pill popper when he/she kills your child, while driving?
You’re the one who said EVERY time, not me. I asked you if they should NEVER check.
“So every time a child gets hurt or cries, ...”
I have zero interest in arguing with you and on my end this is the end of the subject. You can continue by yourself if you like.
Yep. People just have a drink or two to relax. In other words, to catch a buzz.
But the druggie libertarians keep telling me MJ is a victimless crime - nobody gets hurt smoking grass!
Therefore this story must be wrong.
Haven’t read all comments yet, but the foster father is homosexual: http://www.nydailynews.com/news/crime/gay-kansas-dad-leaves-foster-baby-hot-car-article-1.1886984
Maybe gay potheads aren’t ideal foster parents.
Thank you Dr Boozebreath.
A lot of people have used it for pain relief! For insomnia! For appetite increase! To stop epileptic seizures. To prevent BLINDNESS! To CURE CANCER!
Just because you think Reefer Madness was a documentary does not make it so. Cannabis does NOT make anyone a criminal. The law does. There is no justice in an unjust law either.
I didn’t know Bob and Elizabeth are in FL. Thanks, they were able to fool KS for a long time.
“What a total disgrace. Two Perez Hilton types are able to adopt 5 children while high as kites. I shudder at what else has gone on - especially when they were high as kites.”
We all know what was going on. No need to ask.
