CU-Boulder moves to fire professor accused of retaliating against sexual assault victim ( Colorado)

The University of Colorado is moving to fire a tenured faculty member after the Boulder campus paid $825,000 this week to settle a graduate student's allegations that the philosophy professor retaliated against her for reporting she was sexually assaulted by a fellow student.

Chancellor Phil DiStefano recently issued a notice of intent to dismiss associate professor David Barnett, campus spokesman Ryan Huff confirmed to the Daily Camera.

If fired, Barnett would be only the fourth tenured professor ever dismissed by the university in its 138-year history.

Barnett is accused of compiling a 38-page report painting the victim as "sexually promiscuous" and alleging she falsified the report of the assault, according to a notice of intent to sue CU filed by the victim last month.

The move to fire Barnett, who has taught in the philosophy department since 2005, comes as CU already was under federal investigation for possible violations of Title IX, the federal gender-equity law. It also comes six months after a scathing report detailed sexual harassment, bullying and other unprofessional conduct within the philosophy department.

...

The victim, who declined to speak with the Camera, filed the complaint because Barnett "smeared her reputation" and she wanted to prevent something similar from happening to future victims who report sexual misconduct, her attorney, Debra Katz, said.

"She felt it was very important to bring that issue to the attention of the appropriate parties within the university and not only protect her own rights, but to ensure that other people who come forward and report serious Title IX violations are not retaliated against," Katz said.

Katz said that if the university tolerated retaliation, it would have a "chilling effect" on anyone wishing to come forward to report a violation.

Looks to me that they don’t “screen” job applicants very well.

Defending yourself against false sexual assault charges is now retaliation?

May the whistleblower prevail!

“”In speaking with these witnesses and hearing their concerns about the way their testimony had been summarized by ODH, professor Barnett became convinced that ODH had intentionally and systematically manipulated the evidence in order to support a finding of guilt,” Moore said.

“Because ODH operates under a cloak of secrecy and without due process, professor Barnett was concerned that this likely was not an isolated incident and felt ethically obligated to do what he could to stop this abuse of authority, and hopefully in the process correct what he views as a miscarriage of justice against his former student.””

” Barnett is accused of compiling a 38-page report painting the victim as “sexually promiscuous” and alleging she falsified the report of the assault,”

A professor, huh?
What a real brainiac.
Sounds like he had a personal clash with her previously.
Perhaps she spurned him?

Or, told her that feminism is a crock and that she should read Aristotle rather than Simone Beauvior or that a Wemyns studies major is waste of time

He may be guilty but leftist women also know that on a leftist university campus only being called a racist is worse than sexual harassment.

I don’t talk to female students in my office. Any conference they wish must be done in the hall and preferably by Email because all it takes is one of them making a false claim and I am retired in disgrace.

True.
I did once make the mistake of holding the door open for two young ladies at the local college.
Their eyes seemed to roll in their heads similar to that dog in the movie “Beethoven” when he hears “bad dog”.
Then they started stomping and screaming.

Oddly, everyone watching laughed at them.

Guilty of ephat? Whistle blowing?

He claims he thought the investigators falsely convicted the guy.

He collected facts to support his position.

May he prevail and the facts cone out.

If this is all based on a false rape accusation, I hope the University of Colorado is sued into oblivion.

In one of those ‘Epic auto correct fails’ e-books, a manager texts his assistant to see him in his office for a brief conference—auto corrected to ‘cunnilinguis’—before the big meeting. That had to be awkward.

It struck me as the act of some effete jerk whose ego was hurt.

Reading the rest of the linked article, he wasn’t even the suspect in the initiating case.
And his personal investigation into it..
Well, have is an idiot!

CU paid Denver attorney 150,000 clams to investigate and it looks like his opinion convinced their insurer they could lose, so they paid. That’s the insurer’s decision.
It sounds like the professor liked the doctoral student, as his mentor, but you would think a fledgling PhD should be able defend himself, right? So why did the professor stick his oar into what wasn’t his business? Because he thought the guy was railroaded?
It sounds like there were some defamation allegations as well. At the end of the day they could have fought but they didn’t. Now the professor can seek his remedies for wrongful termination.

Exactly. That makes me suspicious and he may have enabled other incidents. Philosophy classes like this are forced on our children as part of the college distribution curriculum.

**************************
The assoc. prof retaliated against her because she reported sexual assault by a FELLOW STUDENT, not the prof.
