Despite promises, Social Security still trying to collect old debts from kin

The Social Security Administration, which announced in April that it would stop trying to collect debts from the children of people who were allegedly overpaid benefits decades ago, has continued to demand such payments and now defends that practice in court documents.

After The Washington Post reported in April that the Treasury Department had confiscated $75 million in tax refunds due to about 400,000 Americans whose ancestors owed money to Social Security, the agency’s acting commissioner, Carolyn Colvin, said efforts to collect on those old debts would cease immediately.

But although some people whose refunds were seized were reimbursed in recent months, some of those same taxpayers have since received new demands from Social Security, asserting that the debts remain and seeking repayment.

What should be done cannot be posted, but whenever these atrocities occur, severe consequences should be visited upon the officials who seize and destroy the lives of blameless citizens.

They’ll rob you to pay off a dead relative’s debt but they’ll give money/benefits to illegals that never paid a friggin dime into SS!

A lot of Democrats should be scared of this line:
In court papers, the agency says the government has a right to collect from children if their parents received benefits meant for the well-being of those children.

A lot of people claimed their kids have learning disabilities to make tests easier and get a couple hundred a month in extra money taking care of a “disabled” kid.
The Republicans could come back in the future and say, “You’re not really retarded/ADD isn’t a disability, pay us back what your parents got”.

I am curious about the full circumstances of the cases involved. The government is capable of spending millions to harass uninvolved third parties for a $5 error. But if someone deliberately collected SS by not reporting a death or some type of fraud, they should have to pay back every nickle plus fines and interest. Which is it? Some of both?

After reading the article, at least some of the cases are outrageous. SS says they can seize children’s assets for alleged “overpayments” because no laws say they can’t. I guess the Bill of Rights isn’t law in some minds. In at least one case, SS says it can’t provide any documentation to establish their claim, but the victim can spend a fortune in court to prove it incorrect.

Actually, that is the operating debt. The current unfunded liabilities (a different form of debt) is now over $100 Trillion!

Outside of that correction, your point is valid in that the amount of debt we are carrying can’t be resolved! We are in for a major SHTF moment that is no longer an if, but a when!

And our son has terminal cancer and applied for SSI - first request denied due to "misunderstanding". Second one approved but they claim he won't get his first check until May - 2 months ago the doctors gave him a 25% chance of living "between 6 months and 2 years"

If he was an illegal, they would be bending over backwards to ensure he was paid this month. We have a lawyer friend who says she may be able to fast-track him so we have some hope.

My wife received one of these demands about a year ago for an alleged overpayment her mother received over TWENTY YEARS ago. The amount was just a few hundred dollars. There is absolutely no way to even know if these things are legitimate, let alone defend yourself against them.

Apparently there was language buried in a bill a few years ago authorizing this “program”.

I will say she was fortunate to talk to someone at the IRS who helped get the thing waived, but not before hours wasted on the phone.

Imagine what would happen in a year’s time if every W-2 earner maxed out their deductions on their W-4s to the extent just shy of false?

Illegals who earn W-2 or wages that are hit with Fed, state and FICA do this all the time. They do it to the point where they owe no taxes whatsoever. They only get hit with FICA, and they b!tch about that ‘payroll taxes’ Ha!

Try asking the agency for the documentation. They don’t have it, all they have is some electronic screen. They can’t even tell you when they paid it, what address they sent it to. show you the initial application for assistance or anything close. Most courts have provisions so you can apply for a stay if you have appealed the case. If anyone gets some sort of a dunning letter, get into the right court lickety split and don’t miss your court dates. Hem hawing around and saying it wasn’t convenient or you missed it because of health or other reasons won’t work.

I am glad your wife go out of it. I hope victims will start contacting their Congressional “Representatives” to demand help with. If they catch enough grief, maybe they will undo this wonderful “program”.
