10 states line up to limit federal power

Ten states now have taken the first step toward limiting the power of the federal government. Officials from Arizona, Massachusetts, Missouri, Montana, New Hampshire, New Jersey, North Dakota, South Carolina, Virginia and Wyoming have filed resolutions calling for a convention of states that would propose amendments to the U.S. Constitution with the express purpose of limiting the power and jurisdiction of the federal government. Article V of the Constitution gives the states the power to call such a convention. The article reads, in part: “The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress.”

What we do not have is Courts or a President willing to do it.

Their goals should be 3 items:

1) Repeal the 17th Amendment,

2) Propose an Amendment that specifically allows the states to Nullify Federal Law.

3) Propose a Constitutional Amendment that allows for the ignoring of Federal Judicial Rulings which overstep Federal Authority under the Federal and State Constitutions.

There are a bunch of states that passed such resolutions, going back about a century. Including many now liberal ones. A few have rescinded their resolutions. Last I saw it was unclear how many of them would still count towards the current total. My understanding is that most older resolutions weren't time limited. And we do have the precedent of last adopted constitutional amendment taking 200 years to ratify, with old votes counting. So we may not need to get all 34 states to act now; although we may need the courts to force Congress to do its mandatory duty when a plausible 34 count exists. We may be able to slip through with some unsuspecting liberal state votes, which they may not be able to rescind in time.

A part of the problem concerning Congress is the 17th Amendment imo. Control of the Senate needs to be returned uniquely to state lawmakers as the Founding States had originally intended.

If 17A is repealed then there should be a provision in the repeal amendment that allows state lawmakers to recall bad-apple federal Senators.

Also, state lawmakers should likewise have power to remove bad-apple justices from the bench on 3/4 state majority vote.

Also, the language from Justice John Marshall’s clarification of Congress’s limited power to lay taxes needs to be amended to the Constitution.

“Congress is not empowered to tax for those purposes which are within the exclusive province of the States.” —Justice John Marshall, Gibbons v. Ogden, 1824.

State lawmakers also need to wake up and consider the following for intrastate schools.

• Reading

• Writing

• Arithmetic

• The federal government’s constitutionally limited powers

Also, the states have never amended the Constitution to prohibit themselves from requiring candidate voters to pass a simple constitutional law test before being allowed to vote. Such a test would emphasize the federal government’s constitutionally limited powers and would hopefully make low-information voters more aware when corrupt federal politicians make constitutionally indefensible promises for federal spending programs and civil rights.

A constitutional proficiency test could be given as part of a written driver’s license test.

As a side note to this thread, please consider the following. Since neither the legislative or executive branches are doing their jobs to protect and defend the Constitution, the Congressional Budget Office needs to publicly report when a bill does not comply with Congress’s constitutional Article I, Section 8-limited powers.
