Obama can do Iran nuclear deal even if Congress disapproves

WASHINGTON (AP) -- The September vote on the Iran nuclear deal is billed as a titanic standoff between President Barack Obama and Congress. Yet even if lawmakers reject the agreement, it's not game-over for the White House.
A congressional vote of disapproval would not prevent Obama from acting on his own to start putting the accord in place. While he probably would take some heavy criticism, this course would let him add the foreign policy breakthrough to his second-term list of accomplishments.

Medellín v. Texas, 552 U.S. 491 (2008), is a United States Supreme Court decision that held that even if an international treaty may constitute an international commitment, it is not binding domestic law unless Congress has enacted statutes implementing it or unless the treaty itself is "self-executing." Also, the Court held that decisions of the International Court of Justice are not binding domestic law and that, without authority from the United States Congress or the Constitution, the President of the United States lacks the power to enforce international treaties or decisions of the International Court of Justice.
Michigan passed the Iran economic sanctions act in 2013 imposing sanctions on Iran based on this precedent. Thank former Texas Solicitor General Ted Cruz for that one.

That’s what I’ve always wanted to know about this.
This “agreement” or “arrangement” is not an official treaty.
They did some half baked congressional vote at the behest of Obama, so that this is not an official treaty, which would require a 2/3 vote in the Senate to be legally binding.
But since whatever comes about will not be legally binding, the next Republican president can simply rescind this on Jan. 20, 2017, right????

The GOP aren't reigning in the Pres because they want the power if they ever take the office.
The only Constitutional power a Pres can do concerning foreign affairs is enter into a Treaty, all this agreement $hit as outside the bounds of the Constitution.

And once Obama releases the billions held because they ARE ....cough cough....WERE.. a terrorist state, they're not going to give it back.

So Iran negotiated 1/3 of a deal. They know how our government works better than Obama and Kerry combined. We have three co-equal branches of government. I know that concept befuddles Mooselimbs, but the Iranian ones know it.
A forced deal isn't worth squat. It's like going to buy a car at a Chrysler dealer with a check requiring three signatures and the other two didn't come with you. The check is no good.
