As if ANYBODY is going to report if the US attempts to actually draft for military service! What the Vietnam War taught about the draft is that should you actually do your duty the political class will hang you ought to dry and will insure that those who were killed or maimed suffered that experience for absolutely NOTHING!
Since the Vietnam War draft dodgers were allowed to return (to adulation, in many cases) the only sensible course of action would be to head for Canada!

We don’t have a draft, and courts almost never get into “what-if” scenarios, where no damages have been suffered (yet). Why did they do so here?

Technically it does not, given the militia was defined as men only, but given women can serve in the armed forces now, an now have every job open to them, the new changes seem to require it for true equality and fairness for everyone.

One can make that argument. It is in the same trendline of the military accepting women in it, and now all jobs open to them. It seems a rational expectation.

You can’t answer the question? It was not taught in any class I had and it was not on the bar review and it is not prominent in my business law practice.
