No need to study Canadian law, just the understanding that almost all nations in the Americas have jus soli citizenship. That should be covered in an undergrad International Law class.

The Dad didn't have American citizenship to give up. So, obtaining Canadian citizenship would have been a good move. Unlike for the Mom.

Unless you're Sir John Templeton, it is generally a bad idea to give up US citizenship if you have it.

It’s really up to the Supreme Court, but then they’ve abdicated on their responsibilities in this area.

If they go back to the immigration act of 1790 it says Natural Born Citizen includes children born abroad to an American father. We know that definition wouldn't be allowed in today's society. If fact today's citizenship policy's lean more to the mothers than the fathers status.

That being said I tend to think we should pay attention to this act as it gives us a clearer idea of what they were thinking back then when they used the term "Natural Born Citizen."

You can be born in a foreign country AND still be an American citizen.

John McCain wasn’t born in the U.S., for example, but his parents were American. Doh’bama may or may not have been born in America, but his mother was American. Having one American parent to me makes McCain, Doh’bama and Cruz natural born citizens in my opinion. There are no standards outlined in the Constitution on this, so I tend to construe the term broadly.

The constitution recites: “No Person except a natural born Citizen, or a Citizen of the United States at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.”

Heck, this to me implies that you don’t need to have been born in the U.S., and Canada (or Kenya) does not issue U.S. birth certificates.

Most Americans don’t hold passports. I guess trump, being all hoity toity, thinks everyone has a passport, because he does, and all his mega rich crony capitalist buddies do, for when, on a whim, they get on their private jets and take a weekend skiing in the Alps, or for that romantic dinner with their third wife in Paris.

You are correct about filling out the necessary papers when born on foreign soil.
Both parents WERE the issue in the original Constitution because the founding fathers did not want a President-Commander in Chief of the Military to be someone of divided loyalties. It is why they insisted, by inserting the words Natural born into the constitution in the final draft, that BOTH parents be American. It was on the advice of John Jay in a letter to George Washington the the “Citizen” wording was changed to “natural born citizen.’

The fact that he had Canadian citizenship indicates the possibility that his mother DID relinquish her American citizenship. Once done, you cannot get it back. Is this why he will not allow his papers to be revealed? What is he hiding?

Lots of children of ex pats are unaware that the country of birth gives automatic citizenship. Renouncing it usually happens when they find out.

How can someone be so ignorant and still be able to work a keyboard? The only thing that Cruz having Canadian citizenship indicates is that he was born in Canada. It says nothing about his mother's citizenship.

I’m so sorry I missed your post, CAC. I did notice that. That it is on scribd would indicate that the author has some kind of professional capacity (subscription/ access) does give it some weight.

There have been articles- you tubes, etc, regarding Cruz (& others) that have been repeatedly removed, so I would think- especially with Cruz being an attorney & having some money behind him (PACs), that if it were patently incorrect and/ or defamatory, there would have been a cease & desist by now.

This isn’t just about Cruz. Not by a long shot. And there’s no question that the democrats are going to come after this hammer & tong (especially after 0bama) with anybody they believe is vulnerable to it.
Worse, WHY is this getting so common? Something stinks.

Most people don’t study law and as an American born overseas to US citizens, I have known my citizenship status all my life. I am a dual citizen and like Cruz am a natural born citizen.

I simply don’t believe that someone as educated as Ted Cruz would not know that Canada considered him a citizen.
