Any idea that women were not fully citizens that may have existed when the constitution was drafted would have been fully repealed when the amendment granting women the right to vote was ratified. So, this guys argument is complete nonsense.

He is eligible because one of his parents was a U.S. citizen and it was a principle of English law at the time the constitution was ratified that the children of English citizens born overseas were considered natural born citizens.

Some may argue that this would only have applied to the father in the late seventeen hundreds when the constitution was adopted. However, after the civil war the 14th Amendment was adopted which made it clear that all people born in the United States were citizens - not just men. And in the early 20th Century, many years before Sen. Cruz was born, 19th Amendment was adopted which granted women the last privilege that had been reserved to men - the right to vote. At this point any distinction that existed between the citizenship rights of men and women in common law at the time of the founders has been clearly amended out of the constitution. This is not due to any idea of a living constitution but through the amendment process set up by the founders.

I’ve heard numerous theories about how Cruz qualifies. Your’s is only the latest. None have come close to persuading me that the Founders intended that someone could be born in Turkey, live there for decades, decide that wanted to thwart the will of the American people, and run for the presidency to do just that.

The problem with ALL of this is that Cruz is running as an Originalist Constitutionalist.

Don’t you see the insanity??

The man was qualified to run for anything he wanted to in Canada. He was a dual citizen until a year and a half ago.

Do you *really* want to open the Pandora’s Box for future POTUS candidates?

Geez! I thought it was bad when we were fighting Obama’s legitimacy. I gave up years ago because it was a no-win situation. Now I find that Conservatives are just as terrible.

No. They’re worse.

They’re worse because they CLAIM to love and respect the Constitution as the supreme law of the land until it irritates them.

At least liberals have the decency to crap on all of it.

I think he is a natural born citizen under an originalist view of the constitution. Please read my argument where I explained why that was the case.

I don’t know. But several candidates pushed to the front before several elections by the bipartisan, socialist political class have indeed been draft dodgers. And the political class is smug about it.

But they also spend too much without producing anything of real value. On to the end of the default processes.

Problem is you are depending on English common Law which is not the definition used by the Founders. Also English Common Law had to deal with a Royal Sovereign and English rules for citizenship under royal authority. We had just gotten rid of the King.Why would they wish to abide by laws of their recent mortal enemy? The Law of Nations was the root for the phrase Natural Born Citizen. It was written by the preeminent legal authority of the time, E. Vattel. Vattel’s natural born citizen is one born on the soil of two citizen parents. Not the same as one citizen parent and born on foreign soil. Diplomats were not held to this law.Cruz is under Origination Constitutionalists NOT eligible.
