Colleges That Ask Applicants About Brushes With the Law Draw Scrutiny

The online admissions application for Auburn University appears simple, until you get to this question on Page 7:

"Have you ever been charged with or convicted of or pled guilty or nolo contendere to a crime other than a minor traffic offense, or are there any criminal charges now pending against you?"

Those who check "yes," even though they have never been convicted of any crime, face extra scrutiny -- a follow-up call from the admissions office asking for additional information, the university says.

Auburn, in Auburn, Ala., is one of 17 universities in the South that include broad questions on their admissions applications about any contact with the legal system or the police that applicants might have had -- even an arrest, with no conviction -- according to the Lawyers' Committee for Civil Rights Under Law, an advocacy group. The universities are now the focus of an inquiry by the organization, which says such questions unfairly penalize minorities, who tend to face arrest more frequently and, as a result, could face higher admissions hurdles.

"The disparities and underrepresentation we see at schools is a concern, and this may indeed be one of the contributing factors," said Kristen Clarke, the group's executive director, citing statistics showing low black enrollment at some of the colleges. At Auburn, for example, African-Americans make up 7 percent of the student body in a state where blacks total about 25 percent of the population.

The organization planned to announce on Thursday that it would inquire about practices at Auburn and the 16 other institutions that it says have applications containing questions about arrests or other contact with the criminal justice system that stops short of a conviction.

Many schools ask about arrest records. Lying about or concealing criminal history is grounds for dismissal.

Who wants gang members or terrorists living in the dorms?

I can see the convicted or plead no contest question but being charged or arrested is a whole nuther question.

Just tell the Auburn admissions folks that you stole a laptop at your previous school and they’ll making you the starting QB.

The NYT wants the criteria changed to allow black on white crime so officials can concentrate on the 2% that goes the other way around.

How do we know this question isn’t asked to ensure potential football players are sufficiently violent and with a criminal nature?

Affirmative Action for Felons? Add that to Affirmative Action for Negroes and Profiling by other students becomes inevitable.

At the rate we’re going, it won’t be long before every college dorm will have a quota for criminals, and all bathrooms, locker rooms, and showers will be unisex lest any of the 57 genders feel excluded.

And why do minorities “face arrest more often”???? I believe most job applications also ask for criminal history. But its only Southern schools that are racist for asking. Sort of like it was the whole South responsible for the murders in Charleston of black church goers when Muslim murders are lone wolves, etc. More anti Southern bigotry by the self described elite.

I know you meant this as a little bit of sarcasm, but 0bama’s education Dept has been putting pressure on colleges (off the record, of course) to ignore criminal histories of black applicants, esp males. Funny the things Federal grants to colleges will buy.
