Vanity: Remember Cloture Rule Still Applies to SCOTUS Nominees

Just a reminder the Cloture rules requiring 60 votes to end debate in the Senate still applies for SCOTUS nominees. Yes Harry Reid dropped the nuke for executive appointments but exempted SCOTUS nominees. If 40 GOPers stand strong the nightmare of Obama getting to replace Scalia shall not pass.

Has there ever been a filibuster of a Supreme Court nominee?

I’m guessing not because Thomas was confirmed in a close 52-48,vote, and Alito was confirmed by only 58-42. Based on these votes, the Democrats could have upheld filibusters if they had chosen to do so..

Just a reminder, Cruz voted for cloture on TPA/Fast Track. Not like we have any leverage there.

My guess is that they will put on some sort of false opposition show, and then confirm an Obama selection, and the reason that they will do this is because they are liberals, and they do not oppose a liberal nominee to the court.

If there is some solid method that can use to block it, they will suspend that method or not use it, and rather pass some phony method that allows them to pretend to oppose it, and they will lose that pretend opposition i.e. something similar to the Corker Bill.

What it boils down to is that they will find a way to convince us that they oppose it, but can’t stop it, and it will happen.

No Borking does not count as a filibuster. Sadly Bork was voted down, but he did get a confirmation vote in the full Senate.
