Attorney General Loretta Lynch has asked not to be considered for the Supreme Court seat left vacant by the late Justice Antonin Scalia.

In a statement, Department of Justice spokeswoman Melanie Newman said that the "limitations inherent in the nomination process" would prevent her from being effective as attorney general.

"Given the urgent issues before the Department of Justice, she asked not to be considered for the position," Newman said.

She and Obama have concluded that she could not survive a Nomination Investigation fight because of her failure to indict Hillary Clinton, so his nomination will be some other diversity zealot.

Too bad. I’m sure her confirmation hearings would have been interesting, asking her why they chose not to prosecute and of the IRS abuses.

Sweetie, no one will be considered for SCOTUS until you're out of office.

Lynch can do more damage as an active and malicious Attorney General than as a failed nominee. Of course she doesn’t want the distraction of a nomination.

Again, I’m mildly surprised.

IMHO, the outcome of the SCOTUS nomination hinges on three things.

1.) Who Obama nominates.

2.) How the Presidential election looks.

3.) Republican chances of holding the U.S. Senate.

If it looks like Democrats will hold the Presidency and win the Senate, Republicans in the Senate may back down.
