I did not reply nicely or properly to your reply to me.

My apologies. I just have a hair trigger on this topic.

I hope you are of the understanding that a NBC means what Bingham says in my quote. Parents meaning mother and father, pretty obvious to me.

No judge can issue an injunction to keep a candidate off the ballot except in a single state.
There were scores of attempts to get injunctions to keep Obama off the ballot in many states, they all failed.
A higher court can always lift an injunction.

Did you see the Term Federal? Yes a federal Judge can and will and its for all states until reversed or the USSC overturns it. And guess what. they are 4-4 right now.

Talkers talk, doers do. Just do it, if you have something. Don’t talk about it.

Sorry Little Jerimiah, I don't get your drift.

A natural born citizen is born of citizen parents on American soil. No more, no less. That was the decision of the Founders and when the 1790 amendment was crafted in a flawed form James Madison and several other Founders insisted that the Statute be repealed not amended to guard against any possibility of foreign born children of citizens being deemed eligible to become president.

An excellent discussion of these points here

The State Department is also very clear as I have discussed up thread. Citizenship obtained by statute is the citizenship of the 14th Amendment. People have agendas and are paid to have opinions but the Constitution, evidence of Founder's intent, early Congressional Actions & contemporaneous court cases tells a very consistent tale.

Why would anyone think Clinton would give Cruz a free citizenship pass? If foreign birth is not a disqualifier, why all the hoopla during the last two elections?

Thank you, I didn’t take offense I was just a bit confused about the point you were making. Having reread out exchange I think perhaps this is the sticking point:

“that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty”

That fragment states that every human being born to citizens with sole allegiance to the USA is a natural born citizen. That seems to restate the traditional definition of NBC.

driftdiver, the above posted by BGS is factual. If you don’t see it - well, none so blind as those who do not want to see.

Yes - thank you - and born within the jurisdiction of the US, ie US soil.

If any contemporary judge or justice at any level of the judiciary should ever agree with your position, I will alter my point of view, but until then, not so much.

“the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens: provided, That the right of citizenship shall not descend to persons whose fathers have never been resident in the United States”.—Naturalization Act of 1790

So you’re accusing citizens who have filed lawsuits against Senator Cruz at the state level to keep him off states’ ballots of “political posturing?”

Interesting. There seems to be some discrepency between our sources. I use Cornell Law web page https://www.law.cornell.edu/uscode/text/8/1101

Under that page, I cant find the section that you appear to be quoting. The section that starts “For the purposes....”

Can you provide to me your source?

Not at all. The State Courts have no incentive to knock out Cruz this early, which is why its either a technically or such a bad legal ruling its worthless. The only ones that matter are the Federal courts and they have a ton of Hillary supporters in them. They get Jurisdiction if and when Cruz is the Nominee. Its the political hacks in the State Judiciary doing the theatrics for now.

Our general election for president is 50 state elections plus a District of Columbia election for the accumulation of state level electors.
States control eligibility via state election law. State court rulings can be appealed to the federal judiciary but the vast majority of eligibility challenges originate at the state level.
Between 2008 and 2014 the Supreme Court of the United States denied hearing every one of 26 petitions to intervene in Obama’s natural born citizenship eligibility.
