Rochester judge accused of drunk incident: 'You can't (pepper) spray me, I'm a judge'

Rochester City Court Judge Leticia Astacio has been accused of another drunken incident after her DWI conviction last year.

Marketplace Mall security guard Alan Pimm responded to a complaint of women refusing to leave an employee bathroom at the Papaya Asian Kitchen and Bar in November.

"That's when one of the females stated, 'You can't (pepper) spray me, I'm a judge,'" Pimm told police, according to his Nov. 29 deposition. "At that point I could tell she was intoxicated, due to her slurred speech and lack of balance.

Pimm, who says he told them to leave while holding a vial of pepper spray, said he recognized her as "Judge Astacio."

Pimm's testimony was made public in a court filing after Astacio was accused of violating the conditions of her drunk driving sentence for a third time. Astacio was stripped of her judicial duties, but not her title or $174,000 salary, after being found guilty of driving while intoxicated in August.

THREE DWIs that would get any of us thrown in jail. Isn’t Affirmative Action great? Just like all Liberal inventions, it is catastrophic. Unless she kills someone, she won’t even have her license lifted. The least they could do is wire the ignition on her car with a siren, so citizens can get out of her way when she’s loaded.

Judges - ALL judges - think of themselves as a privileged class. The laws that apply to us peasants don’t apply to them.

I met an ancestor of this judge back in the 50s in the Texas panhandle. I was in the 5th grade and had a paper route. One winter day the snowplows had made ridges of snow 3 feet high in the curbs. I had an Allstate motor scooter (made by Cushman), and had a cloth paper bag to hold all my papers on the handlebar.

I had thrown a paper at a customer’s porch, and missed, so I parked my scooter, walked up to the customer’s house, and placed the paper on the porch.

As I returned to my scooter at the curb, a kid was messing with my paper bag and scooter, so I told him to stop. He didn’t, and as I cocked my fist and approached him, he shouted, “YOU CAN’T HIT ME—I’M PATROL,” referring to the white helmet and diagonal belt across his chest. He was overseeing the crosswalk in front of the school across the street.

He shouldn’t have said that: In two seconds he was lying in the snowbank, belt and all.

Now, 50 years later, one of his descendants says, “You can’t pepper spray me, I’m a judge.”

This “Judge” is severely alcoholic. When she kills someone during one of her next few DUIs, the court system will be partially liable for aiding and abetting her dangerous behavior. She asked her daughter to take a breathalyzer test for her in order to operate a vehicle. Attributing to delinquency, anyone?
Some people should never, ever drink alcohol.

So she's relieved of her duties but keeps her six figure salary after three violations of her drunk driving sentence (meaning that she was convicted of drunk driving). First, she should be in jail for three violations. Second, how the Hell does she keep her salary?

Quite reluctantly I moved to Rochester (suburbs) 50 years ago. When I moved here, the city was safe, vibrant, and a fun place to live and hang out.
Fifty years later it's now a virtual cesspool ... one of the poorest cities in the country; one of the most violent; HS grad rate under 40%; etc., etc., etc.
And guess what class of people is responsible.
