Did the Obama Administration Try Stacking the Deck Against Trump at the Justice Department?

Amid Thursday’s over-hyped brouhaha about Jeff Sessions meeting with the Russian ambassador, a curious detail emerged. In Sessions's recusal memo, it was explained who at the Justice Department would be handling any investigations into the Trump campaign's alleged ties to Russia. "Consistent with the succession order for the Department of Justice, Acting Deputy Attorney General and U.S. Attorney for the Eastern District of Virginia Dana Boente shall act as and perform the functions of the Attorney General with respect to any matters from which I have recused myself to the extent they exist," reads Sessions's official statement on the matter.

Except that if the Obama administration had its way, Dana Boente wasn't supposed be the U.S. attorney to handle these matters in the event that Sessions recused himself. On February 10, USA Today reported the following:

Seven days before he left office, President Obama changed the order of succession without explanation to remove Boente from the list. Obama's order had listed U.S. attorneys in the District of Columbia, the Northern District of Illinois and the Central District of California.

continued... That seems like awfully suspicious behavior. In fact the USA Today story noted this is pegged to the news that Trump quietly signed an executive order restoring Boente to the line of succession. The Obama administration chicanery was likely brought to White House's attention after Obama holdover and acting Attorney General Sally Yates tried to usurp the powers of the president and countermand his immigration executive order, actions for which she was summarily fired.

Why would the Obama administration make this eleventh-hour change to the line of succession at the Justice Department? "At the time, I was told it was done in consultation with Trump transition," Gregory Korte, the USA Today reporter who wrote the story quoted above, told me Thursday. "Looking back, that's clearly not the case."

Per the article:

The man Obama placed at the head of the line of succession is D.C.’s U.S. Attorney Channing Phillips, who is quite cozy with President Obama and his attorney general, Eric Holder. He is a former senior adviser to Holder, and he stayed on to work under Obama’s next AG Loretta Lynch before Obama appointed Phillips D.C.’s U.S. attorney in 2015. But Phillips goes way back with Holder—Holder first hired Philips in the D.C. U.S. Attorney’s Office in 1994. It’s also safe to say that the AG offices in the Northern District of Illinois and the Central District of California are not hotbeds of Trump supporters.

President Trump has quietly signed an executive order changing the order of succession in the Department of Justice, reversing an executive order by President Obama signed just last month.

The order appears to be the first that Trump has not signed in a public ceremony. It’s dated Thursday — the same day Attorney General Jeff Sessions was sworn in — but was not posted to the White House website until Friday morning. The White House did not explain the discrepancy.

The executive order spells out who will act as the nation’s highest law enforcement officer if the attorney general dies, resigns or becomes incapacitated. Such orders have been routine since the 2001 terrorist attacks, but Trump’s is notable becomes it comes two weeks after he fired acting Attorney General Sally Yates for refusing to defend his executive order banning travelers from seven predominately Muslim countries.

The top positions remain unchanged: the deputy attorney general, the associate attorney general and — at the discretion of the attorney general — the solicitor general and other assistants. But because those positions are now officially vacant, the order currently skips to the Senate-confirmed U.S. attorneys.

I do not understand why Sessions would recuse in favor of his guy who is going to grandstand this thing big time and declare smoking guns where nothing exists. Were it Trump doing the recusal, I would assume it would make Boente and Pelosi et al look really bad.

It will be a moot point shortly. The Deputy Attorney General will be fired soon. The replacement’s confirmation hearing is scheduled for Tuesday. The Turtle should get out of his shell and ram this confirmation through- don’t let the Dems delay it.

The article below spells out how Trump changed one of Obama’s EO’s to change the succession of power at the DOJ. Obama had skipped over Boente and put other lawyers ahead of him.

He should have fired him and all US Attorneys appointed under Obama on Jan 21.

Or transfer them out of the DC offices. I understand that for example, the towns of Madawaska, Maine and Wink, Texas are fine places for branch offices of Assistant US Attorneys.

The Trump team MUST take the gloves off; investigate, prosecute, and send all the traitors to prison. Make public all their dirt starting with Zero, Hitlery, Jarrett, Holder, Lerner, and the rest of their Liberal clan including the Muslim Brotherhood; then move on to RATs in Congress. Start with the RATs and then GOP Elites.

It’s J. Edgar Hoover time and the investigations should have started January 20th. We all know there’s a landfill of dirt to be exposed in DC. IMO, the RATs will be scurrying to cover their litter box and won’t have time for their treasonous plotting.
