Utah lawmakers pass bill to lower DUI limit to 0.05 percent

Utah could soon have the strictest DUI threshold in the nation after state lawmakers on Wednesday night voted to lower the limit for a driver's blood-alcohol content to 0.05 percent, down from 0.08 percent. The measure heads to Utah's governor, who has said he supports the legislation.

So every non-Mormon in the state who enjoys a drink with his/her buddies or at a restaurant can be charged with DUI. If I remember right a under the 0.1 standard a normal person could enjoy a drink a hour. So now one needs to "detox" for an half hour or more just for having a beer.

Stupid law. I am against driver buy I suspect the responsible individual who thinks he might be borderline .08, assuming all normal factors for weight, amount per hour, etc. Is a safer driver because he does not want to get stopped. This will hurt restaurants.

FWIW, I’ve never understood why not imbibing before driving is such a hardship for some folks. Especially pro-lifers.

I hold a Class A CDL. Alcohol limit for a dui on a CDL is .04 per federal law. That applies whether in a commercial vehicle or a private one. I have no issue with it and think everyone should be subject to the same law. The bottom line is “Don’t drink and drive.”....red

Might as well just make it 0.00. That’s what those greedy ba$stards want anyway. It’s always about the Benjamin’s with the court systems. They figure this will double their pocket ‘lining’ money....

Mormons look down on drinkers and feel a need to preach at them. My wife and I ate at a restaurant in Ogden years ago. We were there on business. I asked for a 2nd glass of wine. Waitress said...”are you sure?” I said “are you out of wine”? “No”. I told her to never mind. Tip was minimal as I recall.

The push for ever lower blood alcohol levels for DUI does little or nothing to make roads safer. If the desire is truly to lower the rate of alcohol-related accidents, it would be much more effective to focus on repeat offenders and cases of extremely high blood alcohol content (e.g., > 0.15),which are the causes of the vast majority of alcohol-related fatalities.

The desire to continually push for lower blood alcohol thresholds stems from the same urge of ‘progressives’ who want government to manage every personal detail and habit of our lives.

and I have never understood why alcohol is singled out as the ultimate evil to do while driving, while other things like putting on makeup, eating, talking to others in the car, ect can be just or even more distracting.

I am pro-life without exception and I resent the fact that you would question that because I’ll have a wine while out to dinner. Of course if I thought I was impaired I wouldn’t drive. But I can have a drink without being intoxicated

Why not 0.0? If lower is better then make it ideal and let anyone be arrested for dui. After all it would “give law enforcement more tools.” The govt of Utah obviously feels that citizens need more restrictions placed on them

Really????? Stupid law???? Really???? HAVE YOU, YOU PERSONALLY EVER LOST ANYONE TO A DRUNK DRIVER??? Have you ever seen a wreck caused by a drunk driver, who actually walks away from the accident, while the family of five, mamma, daddy and three little kids are smeared around the vehicle and street???? If you haven’t, pray you never do. The blood and gore can look like a war zone. I have witnessed both. It ain’t pretty. And I believe there sould be ZERO levels of booze in your blood. You can have the Designated Driver, a non-drinker, etc. You DO NOT have to drive. Stupid law my butt.

Sadly, laws tend to cater to the “lowest common denominator”. There are folks who are quite “impaired” at this lower BAC. While they are generally in the minority, they do exist (I’ve known folks who could have half a beer and you really didn’t want them driving for a while... scary).

For the majority, this lower BAC is probably ridiculous. BUT - lets think about it another way: If you are a responsible driver, who HONESTLY is not impaired at .05%, and you obey the traffic laws while driving - this won’t be an issue. Those who ARE impaired at 0.05% - the law will give bigger teeth to.

This is a “below background radiation” law.

That is, background radiation is a normal, tiny amount of radioactivity that is present everywhere in the world, varying slightly between places, except for some “hot spots” like near uranium mines and places like that.

However, leftists opposed to nuclear *anything* have long made impossible rules for nuclear facilities, often that resulted in them being much *less* safe. One of their favorites was to demand that *any* radiation meant contamination, and that the facility had to clean it to the point where it was totally radiation free. That is, below the level of background radiation.

Ironically, Utah was the thirty-sixth state (out of 48) to vote for repeal and thus was responsible for ending alcohol prohibition.

I don't drink by choice. It isn't because of any perceived "self-righteousness" - as I have none. It isn't because I am a religious fanatic (though I am a Baptist pastor). I do not think lower of people who enjoy a drink from time to time. I DO have an issue when alcohol use becomes a "necessity" and it begins to drive people. Personal responsibility, not actually followed, results in laws like the one Utah has apparently passed. Sadly, freedom always is the cost of people not acting responsibly.

What needs to happen is pass a law banning alcohol sales in public establishments for consumption. Period.

One must purchase the alcohol and transport it unopened till the arrive at their home and it must be consumed at home.

Bet’cha after a period of time, lawmakers would be looking to raise tax revenue in other areas.

I'm not in support of what I wrote, but it really pisses me off that law makers LOVE the tax revenue generated by sales of alcohol/dining. Besides, the horrific accidents in large part are not from folks enjoying a couple of drinks with a burger. It's the dumb @$$3$ drinking twice the legal limit that cannot even see to drive.

They've started this nonsense down here in Texas. “Buzzed Driving is Drunk Driving” the signs say. Freakin nanny state.
