Iowa Supreme Court's wrongful death ruling ignites abortion debate

DUBUQUE, Iowa (KCRG TV-9) -- Parents in Iowa can sue for wrongful birth. That first of its kind ruling from the Iowa Supreme Court is stirring up emotions in the abortion debate.

Parents in Lee County filed a lawsuit against a Fort Madison hospital and with a gynecologist clinic. They say doctors failed to warn them about abnormalities on their child's ultrasound. Those abnormalities that might have prompted the parents to get an abortion.

The case centers on a now 6 year old boy who was born with cerebral palsy and other disabilities that make it unlikely he'll ever walk or talk. Proponents of the ruling say the wrongful birth amounts to medical malpractice. But critics say the ruling finds that some kids are better off dead.

Attorney Art Gilloon, is member of Dubuque County Right to Life board of directors.He's shocked and saddened by the Iowa Supreme Court ruling. In a 6 to 1 vote last week, the Supreme Court ruled with the parents saying can sue medical providers.

What this means is that IF you do what a judge may think is WRONG, you open yourself to the nightmare of a lawsuit.
What this means is that IF you do NOT do what what a judge may think is RIGHt, you open yourself to the nightmare of a lawsuit.
Heaven help the patient whose doctor must make a decision on what a court will think years later.

Um, check the title, doesn’t match the story (typo maybe).

So what in blue blazes is getting into the corn that they eat? Something wicked to the Midwest comes?

This is like “Who wished this baby punishment on you, dearie.”

Ah, we knew that “may kill on option” would morph into “must kill.”

God’s heart aches and surely wishes that people’s hearts would. Asking rhetorically: Hey liberals, this ought to surely be your forte if anything was? Or are you simply illiberals in liberals’ clothing? Well sure and fine, dear liberals, find some way to unite America (doesn’t have to be a government program, in fact government programs are a good way to vitiate such things) to help care for the mothers of troubled babies. Which doesn’t require killing the troubled babies, or, God forbid, implying a duty to do that? Surely anything less would be illiberal?

Just damn. I sometimes wish that liberals actually WOULD be liberal. We’d take care of a lot of problems that way.

Imagine what this boy will experience when he realizes that the failure to kill him was the subject of a state supreme court ruling.

At least this is what the doctors are saying. Sometimes they are right; sometimes they are mistaken. If someone with the means and willingness wants to try for a different fate, let it transpire.

I don't think you give people with this disability enough credit. He most likely will gain understanding, as he matures mentally, that he was used as a pawn to affirm some "right" to kill other children just like him.

That can be hell on earth.

I’ve asked God why some folks have to treat their children as private-pride showpieces.

God’s ideas for a child might be different from their own. And the result is going to be one colossal, tragic, and largely needless struggle.

God often has a way of bringing goodness out of the midst of evil. As long as there is good and evil and choice in this world, there will be real life morality stories.

That boy’s biological mother may frown her way down to hell. To the boy it may be a different story; his foster parents may carry the true love of God. He may become so grateful to the foster parents and, yes, ultimately to God, that the hateful forces in his past will become vanquished villains.

Plowman told the court, if she'd known of those abnormalities, she would have terminated her pregnancy. She cited the high medical costs and quality of life for her child.

Quality of life for the child? Or quality of life for her?

I know quite a bit about these kinds of problems.

You refer to people with “this” disability. The story doesn’t give enough information to conclude exactly what this disability consists of. Apparently the child has multiple disabilities. You don’t know.

Very sad situation...is aborting an abnormal unborn childs development a valid solution to lifes problems? Are there other paths or solutions?
