It's still an original. The "defect" here would be that the date on the memo is wrong. If the memo was created in March, and claims to have been created in January, the date on the memo would be viewed as falsified on purpose. But still, there is an "original," it just isn't exactly what it purports to be.

And then there is a question about the truthfulness of the contents. On that count there is direct disagreement. Either Comey is lying, or Trump is lying.

Discretionary and variable. Could be a note in your permanent file, or you could get fired, or you could be sued for money damages. Could be no consequence at all.

I think the culture at the FBI turns a blind eye to politically-motivated leaks, and that the people at the top leak with impunity, and have been doing so "forever."

The memos were an official government document created by a government employee recounting an interaction with a government supervisor discussing government business. But Comey claimed the memos were personal.

Yup. He was supervisor material.

Comey said he wrote the memo in the car on his laptop. I would assume he had that laptop with him in California when he was fired.

If Trump could be Trump, not taking any advice from the know-nothing-do-nothing-spineless (R) ‘advisors’, he could re-use a great (D) ‘tool’: “Can’t we move on?...”, “It’s all in the past...”, “Just how much is this COSTING the American taxpayers...”, “Congress is not getting its job done, instead focusing on a known witch hunt...”, etc.

And GRIND Schumer/Pelosi/Ryan/Turtle with it *EVERY* day. Make ‘em put up, or shut up. The public is already tired of 6+ mo. of nothing.

Petraeus did not get executive-privilege treatment. His communications with Obama were deemed classified and he was prosecuted for failing to safeguard them.

Definitely not presumed classified.

The right word is privileged. There has been a lot written about how comey had the right to release the memo as it relates to privilege. .fbi contract -right and responsibilities is separate matter.

I have no opinion on it because I havent thought it through on privilege issue

Expand on that. What I read is that there is no expectation that privileged material not be leaked to the press.

I will stipulate for talking purposes there is no direct legal consequence such as violation of a criminal statute. What I am seeing though, is "a right to release," focusing on the words "a right."

The snakes are free to subvert the government from inside, and because this is so uncommonly pursued through the courts, there is darn little in the way of controlling legal authority.

Make the wrong daring and big enough, and you get off because it's never been done before!

I cant. I would have to google..reread ..and post links. Too much on my phone. There are several lawyers opining why..how..etc as it relates to executive privilege and the comey memo

Since this is something I skimmed..and didnt think through all the ins and outs...I cant comment...except to say they are opining it doesnt apply in this case..

IIRC.... trumps public comments also have bearing on it

The memo (if it ever existed) was not a grocery list written while at work. It is the [supposed] documentation of a meeting between the Director of the FBI and the President of the United States.

How anyone thinks it is not a work product is beyond me.

Okay. so just some non-specific chit chat, no need to discuss futher.

I have an opinion on how Trump's public comments play in the context of justifying Comey's leak.

I remain troubled by the rule of law that people have the right to leak what is said to them by the president, but if that's what it is, that's what it is.

Comey perpetrated a criminal act. If he will do this he is also quite capable of lying to the public. He in reality is a felon!

His most heinous action was taking the bogus report about Trump partying with Russian Whores and engaging in a golden shower act on a bed. This report was obviously totally bogus. If Comey did not know this was bogus he is an idiot. He is not an idiot, he is a snake in the grass.

He used this report to justify a FISA warrant and this lead to the unmasking of American Citizens which is an illegal act when it leaked.
