Yes, some of that exists, but this is top down subversion by a special prosecutor.

The warrant and fact of the raid are public. Dowd (who is not Manafort's attorney, never was) hasn't even necessarily seen the warrant. Much of his criticism follows from the rules of procedure associated with search warrants, affidavits (or alternative) in support of search warrants, timing of the search, and the people who "check and balance" this sort of activity, that being the investigator and a judge.

He does know some details of the raid, as he asserts privileged documents (communications between Manafort and Manafort's lawyer) were taken. I assume his knowledge of this comes from a report from Manafort.

A couple other articles and part of the Fedrral Rules of Criminal Prodcedure:

Federal Rules of Criminal Procedure - Rule 41. Search and Seizure

41(a)(2)(B) "Daytime" means the hours between 6:00 a.m. and 10:00 p.m. according to local time.

41(e)(2)(A)(ii) execute the warrant during the daytime, unless the judge for good cause expressly authorizes execution at another time;

There is likely a body of case law on what constitutes "good cause" for a raid outside of "daytime" hours, and any competent federal magistrate judge would have insisted that the investigator assert facts or belief that constitute good cause for the timing, as well as for the search and seizure.

Good post.

I don;pt know if a 1983 action lies for seizure of privileged documents. I'm sure such an action would be fact specifici, such as if Manafort was there to assert privilege, and the FBI blew him off without protecting those communications in any way, so a court could decide if the FBI had a right to view.
