Anne Arundel County Circuit Court Judge Larua Kiessling said, from the bench, she received many letters about the case expressing concern about the current political climate where President Trump has been harshly critical of illegal immigration and of Mexico in particular, the Capital Gazette reported. The judge said it is reasonable to conclude that the defendant, Martin Martinez-Ballinas, would flee the scene out of fear of being deported.
Im not going to sentence based on the political environment, Keissling told the courtroom.
Maryland defense attorney Kush Arora told Breitbart Texas that Martinez-Ballinass fear does not matter as to guilt or innocence. It doesnt matter why he ran, only that he knowingly fled the scene. He added that the fear could be considered by the judge as a mitigating factor in sentencing.
The judge then handed down a sentence of six years in prison for what the States attorney called a cowardly act. The maximum sentence for the felony crime is 10 years and a $10,000 fine.
The court convicted Martinez-Ballinas, 29, for fleeing the scene of a February 24 crash that resulted in the death of Marine Lance Corporal James Ray Walden III. Evidence presented in the case revealed Martinez-Ballinas was speeding in his BMW 335i when he lost control while negotiating a curve. He then struck a motorcycle driven by Corporal Walden.
The Mexican national then fled the scene and hid in a nearby quarry. Police found him hiding a short time later. His attorney said his client ran because he was afraid of being deported.

This is of course, satire. Has to be.
The biased judge should have recused herself from this case if she couldn’t control her emotions while wearing the robe.
Why wasn’t he deported?
This yesterdays judge in Texas overturning their Voter ID law. Corrupt, politicized judges in this country are making me see bloody red. They’re really nothing but ambulance chasers with a god complex.
He was driving his underpriveleged BMW 335i.
Reminds me of Forrest Gump’s “girlfriend’s” boyfriend apologizing for hitting her. His apology included something about “That danged Nixon.”
Now I have heard everything.
This judge’s argument doesn’t even hold water. Suppose a paroled felon caused this accident and then left the scene, afraid of being sent back to prison. Do you suppose she would be giving him a pass?
They say that Blue Lives Matter, but the Blues never stop protecting the criminals who wear black robes.
Jose fled the scene because he feared Trumps policy which was not yet formulated?
More likely he fled the scene because:
1) he knew he had done something very wrong
2) he knew he didn’t have a legal driver’s license
3) he didn’t want to go to prison
If this isn’t satire(?),why would he be afraid of being deported? Answer: because he was here illegally. That judge needs to be deported. She is not upholding the Constitution & that should be absolutely unforgivable in a case like this.
Nice that an illegal mexican is driving around in a BMW 335i while I, an actual American is stuck with an 8 year old Mazda..
Remember in the olden days when judges had respect for the law and followed it?
These poor ilegals..if only there was some way they wouldn’t have to suffer these injustices while living in our country ilegally? While soaking Americans for free health care and the like.
I have to admit I am stumpped.
He would have done the same thing before Trump was elected.
I guess you didn't choose pimping or drug dealing as a vocation like he did.
His attorney said his client ran because he was afraid of being deported.
“Okay Johnnie, tell him what he’s won”
“He won a 6 year all paid, all inclusive stay in a private gated community and will be still be deported....!!!”
Wonder what he does for a living?
