You are correct sir, on both accounts. I have a feeling this won’t change in the next two hundred years or so.
Agree ....... Sounds as well they put a lot of responsibility on her versus him checking his own gear..... PFD ? check. Kayak not taking on water within 5 feet of the shore ? duh check.
Sad event .....preventable.
I can’t paddle any more so I sold my kayaks. I have bad heart issues and the one time I dumped it I was really grateful to not have to be swimming at all, I had enough Angina just from the sudden drama as it was. I was at dockside, so I had people rush to help me too. A good PFD is money well spent and some signalling gear is a good addition to it.
Meanwhile, Bergdahl walks free.....

The Plug was on the TOP of the Kayak.
It had nothing to do with the Kayak capsizing, but it made a good story for the Prosecuters to build their Circumstantial Case that the whole thing was planned.
Hard Case to prove, so I’m sure they jumped at her Pleading on the Lesser Charge.
