A security guard who was arrested after a prostitute fell out of his car is suspected of raping more than a dozen women or girls as young as 15 at gunpoint in Los Angeles County, police said Wednesday. Ferdinand Ervin Flowers, 35, of Long Beach, pleaded not guilty Wednesday with kidnapping to commit rape, robbery and assault, prosecutors said.

He was being held on more than $1 million bail. It wasn't immediately clear whether he had an attorney.

Flowers, a security guard, is believed to be the man who in 2014 and 2017 "cajoled" sex workers into his car, then pulled a gun, drove them to an industrial area and robbed and sexually assaulted them before letting them go, said Capt. William Hays, commanding officer of the Los Angeles Police Department Robbery-Homicide Division.

Please don’t flame me, but it seems that if you pick up a prostitute and then “sexually assault” her, it is only “sexual assault” if you didn’t pay.

Well, if you assume all the power at the point of a gun, and engage in abusive, not-agreed upon sex acts, is it still just shoplifting? There can be a significant element of coercion and terror, which is more than just a commercial payment issue.

It’s the “at gunpoint” part that makes it assault. This is exactly the type of thing that makes a prostitute’s line of work a high-risk one.

Regarding a prostitute, it’s a squishy issue. There is the binary difference, and then how people see it and how it is perceived by many in the real world. It’s why, as someone else pointed out, it’s a dangerous occupation.

It’s sexual assault if they don’t want to and you force them to...

You also left out the part where he robbed them...

Yes, because robbery and sexual assault are not the same thing. I was just focusing on one aspect of it.

I was sort of being in jest with that post, but it does beg the question. If a prostitute agrees to be paid after the fact, but then the John stiffs her (no pun intended), is it shoplifting, or is it sexual assault?

If force or fear are involved, it is robbery.

The sexual equivalent of a “dine & dash”?

At least prostitutes are not outing johns on social media for giving them a really small tip...

Prostitutes have as much right to say “no” as anyone else. The law makes no distinction between raping a prostitute and raping a nun. The actions of the rapist determine the charges, not the perceived quality of the victim. And that’s the way it should be. Once you accept that certain people don’t deserve the benefits of our legal system, no one does.
