The professor is a woman. The U. refuses to releases stats to prove her wrong. Stats that were used to track performance by race in a study outside the U prove her right. Dramatically.

- not delivering the promised services (classes disturbed)
- allowing the value of a Penn degree to be diminished

Penn denounced the professor's statements without citing any statistics to refute the substance of her statements, which is what is classified as a “non-denial denial”. Good money is betting that the professor spoke the truth about how few black students there are at the top of the class at Penn.

The professor is actually a she. And the dean punished her for speaking a falsehood, but has offered no supporting data for claiming that the assertion she made was in fact false. There was also a miss-attribution of a quote that affirmative action admitted students were not equipped to compete at a college level; the quote was twisted to “Penn students”, when she referred to the broader effect at all colleges.
