Timing – Chairman Goodlatte and Chairman Gowdy Schedule Testimony From Bill Priestap…

There is a particular coordination of events that has been visible since December 2017 when the first evidence of the FBI and DOJ operations against the Trump campaign surfaced. In the past six months a great deal of granular timing relates to this coordination. In January 2017 the DOJ IG began investigating FBI and DOJ conduct during the Clinton investigation in 2015 and 2016.

Toward the end of 2017 a joint House Judiciary Committee and House Oversight Committee venture was established to look into the FBI/DOJ handling of the Clinton investigation, and the Trump counterintelligence investigation. Judiciary Chairman Goodlatte and Oversight Chairman Gowdy established the joint-oversight venture and then little happened as they awaited the completion of the OIG internal review.

Between the Fall of 2017 and May 2018 the final stages of the DOJ-OIG investigative inquires took place. In this period DOJ Inspector General Michael Horowitz was joined with federal prosecutor John Huber. Horowitz focused on the ongoing internal investigation, while Huber received evidence carved out that holds value for criminal prosecutions.

During the period of January through May 2018 all congressional witness testimony from the FBI and DOJ participants to oversight committees was filtered through the need for U.S. Attorney John Huber to retain the integrity of criminal evidence. Toward that end, testimony from multiple witnesses, sought by congress upon members of the DOJ and FBI, was cancelled. Some of that testimony was cancelled at the last minute as the DOJ negotiated with congress and likely explained the reasoning therein. Example:

Is there anything other than Sundance's fanciful thinking to support the assertion that AG Sessions secretly unrecused himself and appointed US Attorney Huber a special delegation of power to go outside of his Utah judicial district and commence an investigation into crime using a grand jury within the district of the District of Columbia? Bypassing the USAO-DC?

Because if Sessions did not unrecuse himself, then we are relying on Rosenstein to have appointed Huber to this task. Does anyone really think Rosenstein would do this?

Congressional hearings being scheduled across June with Bill Priestap and other major players in Spygate/Hillary’s email scandal. I believe that the DoJ IG will be on deck as well, for some engaging Summertime TV.

AG Sessions stated that he assigned Huber to look into the referrals from Horowitz, in writing to Chairman Grassley. That is when Huber’s name became public in this scandal. As a US Attorney, Huber already has the authority to investigate and prosecute crimes - he would be liable if he had knowledge, and did not.

That is the way it is supposed to work, if you have honest folks in office - no need for Special Prosecutors, when normal prosecutors function according to the law.

Yeah, in Utah. The headquarters of the DOJ, FBI, CIA and NSA are not in Utah.

Well, there were other prosecutors available but they are preoccupied with the likes of Libby Schaaf and finding all of the bad actors in Las Vegas.

But Intelligence Community facilities, like datacenters, which may have been the nexus of a criminal abuse, are.

Also, the AG can designate at will. If he did, the normal thing would be to reveal as little about ongoing investigations as possible, downplaying them to avoid alerting subjects.

Attorney General Jeff Sessions may have declined calls to appoint a second special counsel to investigate the FBI’s behavior during the 2016 campaign, but the man he has picked to lead an internal Justice Department review is a special counsel in every way but name.

John W. Huber, the U.S. attorney in Utah, can convene a grand jury, issue subpoenas, collect evidence and order witnesses to testify — all the usual powers a federal prosecutor has — as he delves into whether the FBI abused its powers when it sought permission and then carried out wiretapping of a Trump campaign figure, or whether it trod too lightly in pursuing questions about Democratic presidential candidate Hillary Clinton.

Mr. Sessions said the facts of the FBI situation don’t yet rise to the level of demanding a special counsel, but Mr. Huber is as close as can be.

That's quite true.

But would it surprise anyone who has been a long observer of Washington if what actually happens in the DOJ re the spying on Trump and the abuse of FISA is exactly nothing until the IG hands in his report 15 months from now?

My suspicion is that what AG Sessions has done is to merely ask Huber to review along with a small team of a few other DOJ lawyers, concerns raised by Republicans in Congress with a view to evaluating them to consider what kind of legal issues are implicated by them.

I suspect that AG Sessions has not gone further to actually delegate to Huber the power to do a criminal investigation in the District of Columbia of illegal US government actions taken regarding the Trump campaign, because going that far would violate his recusal.

And that the reason Sessions has been so vague and coy on this is because he has taken such heat for recusing himself and doesn’t want to bring even more heat on himself.

He is in a box, beholden to Rosenstein, and crossing his fingers that Rosenstein’s actions as Acting AG do not end up destroying Sessions’ legacy and reputation after such a long and accomplished career in public office.

Looks like Huber has been tasked to review matters raised by the committees and to make recommendations, to Rosenstein and to Sessions as appropriate, about opening investigations, increasing resources to existing investigations and potentially appointing a Special Council.

I don't think Huber is conducting a specific investigation, enpaneling a GJ and all that. That's the added sauce from sundance.
