#7. What makes this very interesting is the fact that David Cole wrote this position article. He is one of the ACLU’s top leftist lawyers, and came out of the Communist Party USA’s legal front the National Lawyers Guild-created “Center for Constitutional Rights”.

Creators of the CCR were other hardcore Marxists and leftists such as William Kunstler - hardcore CP supporter re legal issues and causes (NECLC, NACHUAC/HISC, NCARL, etc); the CP’s frontman lawyer Arthur Kinoy (Prof., Princeton Law);(the late Michael Kunstler, who died many decades ago), Philip Hirshkopf, a very strange ACLU lawyer (who left Kunstler’s firm for private practice); Morton Stavis, long identified member of the CPUSA, and Peter Weiss, another hardcore Marxist sympathizer if not secret member of the CPUSA, the husband of Hanoi supporter Cora Weiss/COLIFAM, the Institute for Policy Studies, a Marxist “think tank and illegal lobbying organization in DC”, the anti-Israel “Americans for Peace Now”, and a one-time leader of the American Foundation for African Students Organization (or something like that).

Cole used to teach law at Georgetown Un. Law School before, apparently, getting what is now a full time job with the ACLU.

He’s still on the Left but this position of his is either a commitment to the Constitution (which the reds openly use to destroy it) or as some projected, simply an ACLU effort to protect its ass from conservative criticisms of hypocrisy/favoritism in choosing what cases to take re constitutional issues, or maybe somewhere inbetween.

Only time will tell.

It’s especially odd because the ACLU had recently backed away from supporting the free speech rights of gun rights advocates. Maybe they’re worried the same tactics the Clintonian establishment is using against conservatives now will be turned on the Bernie Bros?

Cole has apparently done a 180 on this since dissenting ACLU leaders leaked a memo he wrote:

In the Wall Street Journal last week, Kaminer highlighted a leaked memo about the ACLU’s procedures for taking on cases. In speech cases, the memo says, the organization will consider the context of the speech, “the potential effect on marginalized communities,” whether the speech advances the goals of speakers whose “views are contrary to our values” and “structural and power inequalities in the community in which the speech will occur.” Weighing content against speech rights, Kaminer argues, reflects “a demotion of free speech in the ACLU’s hierarchy of values.”

The ACLU’s defenders say the memo merely regularizes a long-standing need to resolve conflicts between the group’s civil liberties and civil rights agendas. David Cole, the ACLU’s legal director, who oversaw the creation of the memo, tells me, “We’ve had to face these conflicts since the founding of the ACLU. And that reflects the fact that we chose to be a multiple-issue organization.” Nonetheless, he says, the ACLU still fights fiercely to protect unpopular speech, including for conservatives such as Milo Yiannopoulos. These sentiments are echoed by Nadine Strossen, the organization’s former head.

But Ira Glasser, Strossen’s predecessor, sides with Kaminer: “To deny that this departure from free speech policy is a departure is intellectually dishonest, an Orwellian smokescreen thrown up to obscure what they are doing.”

Great information. It is interesting to see who of the ACLU leaders are taking which side of the “free speech” argument.

I can’t tell whether Nadine Stroessner is a “good one” on this issue or not.

The same for Glasser who is a first class Marxist sympathizer.

Cole is hedging his bets, which leftists like him often do in terms of self or cause preservation.

“Food fight”. Hope it gets downright nasty.

More like a ploy for the ACLU to “prove” even conservatives should trust them...likely what they propose (NRA having it’s day in court) would occur w/o the ACLU “weighing in”...

Cuomo will get reelected because the Democrats have the state sealed up politically.

This won't be a repeat of Mario losing to a Republican over 20 years ago. I am not happy about the prospect of a third term for Andrew.

It is likely much to do with, as they state in the article, if NY can do this to the NRA then any state can do it to any organization. I don’t like how the ACLU often seems to pick and choose which civil liberties are more preferred than others, but this isn’t a gun-rights issue it is a 1st Amendment issue and they have a self-interest too in nipping this kind of overbearing governmental abuse in the bud.
