Because mental health hospitalizations are covered under medical privacy laws. The background check system is flagged only if mental illness was adjudicated in court. This is becoming a growing concern.

Technically, he can't, but that would require telling the truth on that form 4473 when you purchase the firearm. Lying on that is a felony, by the way.
This is an old issue that has never been satisfactorily resolved. It came up in the Elliot Rodger killings in San Bernardino in 2014 - here was a young man who had been medicated for mental problems since age 8 whose known issues and treatments were never communicated to the NICS because of the California Medical Associations (perfectly justified, IMHO) concerns about patient confidentiality. So all these young men had to do was lie.
It's an open question - how far can you go in giving this sort of information to the federal government without crossing the privacy line? Can you give them a list of medical marijuana prescriptions, none of whose recipients are technically allowed to purchase a firearm? What about Ritalin? If the answer is Yes, you open a Pandora's box of patient-doctor confidentiality issues, if it's No you have to explain to the world why that crazy person just purchased the guns that he used in a murder. If there's middle ground, wouldn't it be nice to have lawmakers make a legitimate effort to find it instead of posturing for the cameras?
Adolescents and pre-adolescents who experience bitter divorces of parents have a substantially higher risk of mental health problems. I’m sure the government spent large sums of taxpayer dollars for several studies that have come up with those shocking results.

And why should that matter to someone who is making the purchase in order to commit more felonies?

The meds just turn people into zombies. They don’t really work in the sense of actually moving towards curing the condition.
If he came negative on an NCIC check, then you cannot the shop owner for making the sale. As far as I know, people who have mental health issues, that have been hospitalized do not come up in the system. A major flaw obviously.
